third country removals and chain refoulement will go down in history as US crimes against humanity

“DHS has used third-country removal to terrorize people who have been authorized to live here for decades and to cir vent protections granted by the immigration courts,” said Matt Adams, legal director at the Northwest Immigrant Rights Project, joint counsel for the plaintiffs in the case. “The First Circuit’s holding makes clear that DHS’s third-country removal program blatantly violates the law.”

“People removed under this policy have been dumped without do entation in countries where they have never lived, they have faced abuses including arbitrary detention and physical abuse in those third countries, as well as onward removal to countries from which the United States has granted them protection,” said Anwen Hughes, Senior Director of Legal Strategy, Refugee Programs, with Human Rights First.

More than 25,000 people have been expelled to third countries during President Trump’s second term, according to Third Country Deportation Watch.

The case, D.V.D. vs. the Department of Homeland Security, began early in Trump’s second term with a handful of plaintiffs who said they feared they would be deported to a third country under a new ICE policy. It was then expanded to include the whole class of immigrants who could be potential targets, many of whom had lived in the U.S. for decades. “D.V.D” are the initials of the lead plaintiff.

we've reached the disappearing people into US custody phase, cutting off detainees from access to family or the courts

this will eventually lead to US citizens getting disappeared into immigration custody and foreign countries

we used to clown on the USSR for doing like tis, now we are them

U.S. Immigration and Customs Enforcement has stopped publicly revealing where it is holding thousands of detainees who are subject to final deportation orders, an unannounced move that has made it far more difficult for lawyers and relatives to find them, according to current and former officials familiar with the practice.

ICE removed those detainees from its online detainee locator system on Sept. 15, according to three current and former ICE officials who spoke on condition of anonymity because they were not authorized to discuss the change. Several lawyers contacted by The Associated Press confirmed their clients vanished from the system this week, and the American Immigration Lawyers Association warned its members about the situation Friday.

The move represents a stark departure from previous practice and highlights the hardline nature of President Donald Trump’s immigration crackdown, leaving thousands of detainees exceedingly hard to trace and potentially unable to exercise all of their legal options.

is it extreme and radical to dissolve English common law rights guaranteed since 1215 CE?

The act is often wrongly described as the origin of the writ of habeas corpus. But the writ of habeas corpus had existed in various forms in England for at least five centuries before and is thought to have originated in the Assize of Clarendon of 1166.[3] It was guaranteed, but not created, by Magna Carta in 1215, whose article 39 reads (translated from Latin): "No freeman shall be taken or imprisoned or disseised or exiled or in any way destroyed, nor will we go upon him nor will we send upon him except upon the lawful judgement of his peers or the law of the land."[2] The 1679 act followed an earlier Habeas Corpus Act 1640 (16 Cha. 1. c. 10), which established that the command of the king or the Privy Council was no answer to a pe ion of habeas corpus.

    Third country removals blocked

The Trump administration’s third-country removal policy is blocked.

The First Circuit says the third-country removal final judgment from Judge Murphy is back in effect.

“Consistent with this court's September 18, 2026, Judgment, the March 16, 2026, stay pending appeal is dissolved.”

~25,000 souls have been refouled by Trump

Between 2025 and August 2026, the Trump administration deported over 25,000 people to countries other than their country of origin. Very few of these removals were publicly announced by the US. The Deportation Project tracked them, and depicted them in this map.

seems the new tack is straight up ignoring court orders

egging on a cons utional crisis leading up to t
    he midterms is a choice

ICE is trying to ignore the appeals court decision striking down its third-country removal policy, using the thinnest of legal technicalities as a justification.

It wants to expel a Peruvian man to the Central African Republic tomorrow.

SCOTUS ignores harm, grants cert in 3rd country deportation case

They keep letting Trump trample the law and hurt people while they ponder the merits of the case

If “irreparable harm” means anything, it means being sent to a country you’ve never seen, where you may well be imprisoned, tortured, or killed, under a policy that (the cert grant implicitly acknowledges!) may well be illegal

It’s been clear since the first round of Alien Enemies Act “deportations” to CECOT that the U.S. is outsourcing immigrant detention to countries that have less robust human rights protections. It is a continuing disgrace that the Court pretends not to know this.

ICE disappearing children is pretty much a recipe for child-trafficking

“Since the day he took office Donald Trump has been going out of his way to endanger migrant children and leave them at risk of falling into horrific cycles of trafficking and other abuse,” Wyden said. “I’m extremely concerned that the new ICE detention facility planned for construction in Louisiana will be another black box location for the Trump administration to disappear migrant children with no oversight and no accountability.”

Trump appointed judge orders man improperly removed to Equitorial Guinea to be returned to the US

A federal judge has ordered the Department of Homeland Security to return Ahmed Soliman to the United States, five months after he was expelled to Equatorial Guinea, a country where he has no ties, in a decision that could have far-reaching implications for thousands of others subjected to the Trump administration’s third-country removal scheme.Arizona District Court Judge John C. Hinderaker, a Trump appointee, ruled that DHS violated the Due Process Clause of the Fifth Amendment and “must facilitate Plaintiff’s release from custody in Equatorial Guinea and return to the United States and must ensure his case is handled as it would have been had he not been improperly sent to Equatorial Guinea.”

Soliman has been held incommunicado by Equatoguinean authorities since September 11 after speaking to media, including the Prospect, about poor conditions at the hotel where he and dozens of other third-country nationals had been imprisoned for months.

Dana Camilleri, one of Soliman’s attorneys, said they are cautiously optimistic.

“Our reaction was relief and hope that he’s going to be able to come home and reunite with his family,” Camilleri told the Prospect. “I also am still thinking of everyone who’s confined at the hotel there and wanting to get them home. It’s a great step forward, but I’m a little cautious, honestly.”

Camilleri noted that DHS can appeal to the Ninth Circuit. DHS did not immediately respond to a request for comment.

News about the order was first reported by the Arizona Daily Star.

Soliman, 31, was born in Egypt but came to the U.S. with his family when he was four years old. He lost his immigration status after a 2023 conviction relating to a car accident he caused while driving under the influence. In interviews, Soliman said he’d turned to drugs as a teenager after being raised in a conservative religious family and realizing he was gay.

ICE ordered him to be removed in October 2025, but his attorneys had won protections for him barring removal to Egypt, based on his sexuality and because his family had been persecuted by the government there. Relatives in Egypt with the same unique last name have been tortured, imprisoned, and disappeared, his attorneys said.
After months in ICE custody in Arizona, where he had an active habeas case, Soliman was abruptly moved to Louisiana in April. He has consistently maintained that he was only informed where he was being removed to minutes before he was forced onto a chartered ICE flight, and that when he immediately asked for a credible fear interview, his request was ignored. When he asked to see his passport or travel do ent, federal agents refused, before eventually admitting they didn’t have any.

“I came here as a ghost,” Soliman told the Prospect last month.
DOJ attorneys must notify the judge within three days on its progress in returning Soliman to the U.S., according to the order.

    Epic waste, fraud and abuse

    Clear evidence of sadistic intent

    Stephen Miller belongs in prison

In early 2026, Homeland Security bought 11 warehouses to turn into ICE detention facilities. They spent about a billion dollars on these.

NPR spoke to an official at a government contractor whose company was approached to convert several of the warehouses into ICE facilities. He spoke on the condition of anonymity for fear of retaliation from the government.

"No one that we spoke to at DHS was for this idea whatsoever. The deputy director told us point-blank that they had pushed back very hard on it. Everybody knew warehouses are horrible places to put people," he says.

At a meeting with a deputy director at DHS, he says, his company proposed an alternative: FEMA-style camps in Texas that would be more humane.

He says that idea was swiftly shot down. While White House adviser Stephen Miller was not at the meeting, they were told that this was not what Miller wanted.

The contractor says his understanding from that meeting was that "Miller did not want the facilities that were comfortable. He did not want facilities that were humane. We were told point-blank that that was not what the administration wanted."

"Steve Miller certainly seemed to make that point to everyone that he wanted it to be cruel. This was what Miller had stated to the DHS at that time, to the DHS director and deputy director. What surprised me was just how adamant the people were that it was going to happen. Damn the consequences. I would say in 25 years of working with the U.S. government, I've never been in that position before."

"It very quickly became an absolute boondoggle," says Michael Wriston, a former military intelligence analyst who co-founded Project SaltBox, a watchdog group that tracks ICE's expansion. "It was really about the optics of people being kept in these cages and these large warehouses. They wanted a lot of what they called B-roll to play on social media, but they didn't do any due diligence of making sure that they conformed with environmental policy or that the construction wouldn't disturb local water tables."

A DHS official who served during Trump's first term, who spoke on the condition of anonymity because they feared government retaliation, says that while they were not in the meeting the contractor described to NPR, they had often heard higher-ups in the administration wanting to make a point of showcasing difficult conditions immigrants were being held in.

So what's happening with the warehouses now? Well, ICE is now trying to offload most of them "at a steep discount."

In other words, ICE effectively set millions of dollars on fire for a complete boondoggle.

slave galleys for immigrants denied due process on military prison ships costing millions per trip

not hard to imagine that these will be politically radioactive in ports of destination and refused disembarking at multiple locations before having to return their cargo to the US, to be re-interned in the US immigrant gulag

The Trump administration is considering using ships, including a 500-foot training vessel and ferries, to deport migrants to Central and South America on journeys that could take days and cost millions of dollars, according to two U.S. officials.

The discussions over recent weeks are still preliminary, but officials have identified possible ships, including the Training Ship Golden Bear, a maritime academy vessel docked in California, said one person who spoke on the condition of anonymity because of the sensitivity of the plan. Defense Department officials have also reached out to companies about ships in Europe, the official said.

A different official, from the Department of Homeland Security, which oversees deportations, cautioned that the plan was still hypothetical and that no decisions had been made.
It is not clear why officials are entertaining such an unusual plan, considering the logistical challenges, high cost and checkered history of deportations by sea. The plan could, however, offload some deportation costs from Homeland Security to the Defense Department.
“What ICE is functionally contemplating is prison ships,” said Claire Trickler-McNulty, a former top official at Immigration and Customs Enforcement during the Biden administration. “That raises serious concerns at every step. Moving people through international waters and past other countries’ territory for days at a time raises hard questions about which laws apply and who has jurisdiction if something goes wrong.”

She added that “holding hundreds of people on a ship is also an enormous operational and safety challenge.”
