I just think you can keep the rule's punch while still fairly applying it to all situations. Just word it to say, "Any player actively involved in escalating an altercation will be punished accordingly by the league." They can still suspend guys who actually contribute to the problem, and can apply and adapt the rule to different situations.
And don't get me started on Stern trying to "whiten" up professional basketball to appeal towards Middle America. It's a flawed and dangerous concept on so many levels. There are a bunch of reasons why the NBA is struggling, and the "hip hop culture" is pretty far down that list.

Works fine for me, but I don't think the league has the slightest interest in changing the rules.
I agree that it's a bad idea. Even if the number one reason for the league struggling were that middle American white people feel alienated from the NBA, that still wouldn't mean that it would be a smart idea.
The best thing the league can do to regain popularity is what they're already doing -- improve the product on the court with more great team play on both offense and defense, and reduce the number of dull isos that slow the game to a crawl. From where I sit, NBA basketball is a drastically better product than it was 5 years ago, and they just need to find some hooks to get more people to sample it again.
