    Trump Says He’s Sending the National Guard. On the Border, Many Aren’t Sure Why.

    “We’re toughening up at the border,”

    Mr. Trump told an audience in West Virginia.

    “We’re throwing them out by the hundreds.”


    There was little evidence of that this week at the border,

    where a steady flow of immigrants made their way out of the detention center, through the relief center, and from there, onward to cities around the country.

    Border apprehensions have slid significantly over the past year,

    but the Department of Homeland Security announced Thursday that illegal border crossings had surged in March:
    The 37,393 individuals apprehended on the Southwest border was a 203 percent increase over the same period in March 2017,

    though the number was lower than in 2013 and 2014

    here in the Rio Grande Valley at the southern tip of Texas, one of the busiest corridors for human smuggling and illegal entry into the United States, the issue takes on a far more nuanced tone.

    that with or without the National Guard, and with or without the White House’s increasingly anti-immigrant rhetoric,

    people would keep crossing.

    They worry that a deployment of troops would hurt the region’s economy and add to the inaccurate perception that Texas’ border cities were unsafe.

    “We’ll get the bad publicity,”

    said Tony Martinez, the mayor of Brownsville, an hour’s drive to the east.

    “Nobody is sitting around here locking their doors and taping up their windows.

    It’s not a matter of security.

    Immigrants don’t want to migrate.

    They have to.

    This charade that Washington, or

    Trump more particularly, is imposing on the border is nothing more than empty rhetoric.”

    Former immigration judge: Sessions's quota plan a 'bribe,' 'affront to judicial independence'

    it really amounts to “is an affront to judicial independence and the due process of law,” former immigration judge Bruce Einhorn, adjunct professor of immigration, asylum and refugee law at Pepperdine, writes in an extraordinary op-ed:

    Under the Trump-Sessions plan, each immigration judge, regardless of the nature and scope of proceedings assigned to him or her, will be required to complete 700 cases in a year to qualify for a “satisfactory” performance rating.

    It follows that only judges who complete more, perhaps many more, than 700 cases per year will qualify for a higher performance rating and, with it, a possible raise in pay.


    Essentially, the administration’s plan is to bribe judges to hear and complete more cases regardless of their substance and complexity,

    with the corollary that judges who defy the quota imposed on them will be regarded as substandard and subject to penalties.

    The plan should be seen for what it is:

    an attempt to undermine judicial independence and compel immigration judges to look over their shoulders to make sure that the administration is smiling at them.

    Essentially, an unofficial member of Donald Trump’s administration,

    financially rewarded if they efficiently carry out his

    dark vision of ethnic cleansing and

    tearing immigrant families apart,

    no matter how long they’ve been here,

    no matter the U.S. citizen kids they’ll leave behind, and

    no matter if they had no criminal record at all.


    “This is a genuine threat to the independence of the immigration bench,” Einhorn writes.

    The Supreme Court’s new sports betting decision has terrible news for Trump’s immigration crackdown

    Today's good news for Atlantic City is also good news for sanctuary cities.

    The Supreme Court struck down a federal law on Monday that effectively prevented the state of New Jersey from legalizing sports betting.

    Though the Court’s decision in
    Murphy v. NCAA produced some disagreement about how much of this federal law needs to be excised, no justice rose to the statute’s defense.

    It also bolsters the legal case against the Trump administration’s crackdown on so-called “sanctuary cities.”

    The reason why stems from the Supreme Court’s “anticommandeering” doctrine, which prohibits Congress from effectively drafting states into federal law enforcement.

    As the Court held in
    New York v. United States, “we have always understood that even where Congress has the authority under the Cons ution to pass laws requiring or prohibiting certain acts, it lacks the power directly to compel the States to require or prohibit those acts.”

    The core holding of Murphy is that the anticommandeering doctrine applies equally to federal laws requiring state officials to take a particular action and federal laws prohibiting state lawmakers from enacting a particular law.

    “Congress,” Alito explains, “cannot issue direct orders to state legislatures.”

    Because there are relatively few federal officers empowered to target undo ented immigrants, the

    Trump administration wants to conscript state and local police forces into the broader effort to round up and deport such immigrants.

    The term “sanctuary cities” refers to municipalities that
    do not permit their police force to assist in such an effort. ICE may still lawfully target immigrants in such sanctuary cities, but they must use their own resources will not receive help from local cops.

    Under the anticommandeering doctrine, state and local governments have an absolute right to refuse such assistance to ICE agents.

    the Court’s right flank is unlikely to create an exception to the anticommandeering doctrine solely because Donald Trump wants one.

    By cracking down on sanctuary cities, in other words, Trump isn’t simply asking the Court to ignore longstanding doctrine.

    He’s asking his allies on the Court to ignore a doctrine that they and their allies helped bring to life.


    One could say the Trump administration is facing some long odds.
