linkThe Department of Labor is seeking an injunction barring Smoothstack and Kuiper from continuing to demand training repayments from employees, which it claims employees’ wages below federal minimums in a scheme “akin to modern-day indentured servitude,” according to the lawsuit. It also seeks to bar the company from retaliating against employees who file whistleblower complaints.
Labor solicitor Seema Nanda said in a statement that Smoothstack “brazenly disregarded the law by creating a system that traps workers in jobs through outrageous and illegal contracts.”
According to the lawsuit, Smoothstack hires tech workers for a period of two years divided in three stages: First as unpaid trainees for two to three weeks, then as trainees earning the minimum wage of whatever state they reside in, and finally as salaried employees placed with a Smoothstack client, where they earn $60,000 to $70,000 annually.
Smoothstack requires recruits to sign agreements in order to advance through each phase of employment, but does not disclose the TRAP agreements until after an employee has accepted an offer of full-time paid employment with a client, according to the lawsuit.
Employees who leave the company before they have fulfilled their 4,000 hour billable commitment period — about two years — are liable for $24,000 to $30,000 to the companies depending on their time of employment. The TRAP is triggered whether the employee resigns or is terminated for cause before fulfilling the 4,000 hour requirement or if they breach any other part of the commitment.
The DOL further charges that Smoothstack does not pay overtime hours for trainees, who can work as much as 84 hours in a week, and instructs employees not to record hours worked over 40 in a workweek while they are earning the minimum wage.
It is the second lawsuit against Smoothstack in as many years charging the company with violating federal minimum wage standards. A former employee in Colorado filed a class-action lawsuit in federal court in Alexandria, VA. last year, accusing the company of underpaying trainees and continuing to do so even when they start working at one of the company’s clients.
The former employee, Justin O’Brien of Colorado, is represented by lawyers of the Student Borrower Protection Center (SBPC) and Towards Justice.
Winston Berkman-Breen, SBPC’s legal director, applauded the DOL’s suit, saying it reaffirms their arguments that “luring low-wage workers with false promises of rigorous training and future employment with Fortune 500 companies in order to trap them in coercive contracts, and threatening to sue them for up to $30,000 if they dare to leave the company for any reason at all, breaks the law.”

Albertsons Companies, Safeway Inc., and The Vons Companies operate 589 stores in California under the brand name banners of Albertsons, Safeway, Vons, and others. In Alameda County, there are approximately 28 Safeway stores.
The civil action and stipulated judgment were filed in Marin Superior Court. The Alameda County DA’s Office’s Consumer Justice Bureau joined the suit with the District Attorneys of Marin, Los Angeles, Riverside, San Diego, Sonoma, and Ventura counties.
The civil complaint alleges that these companies unlawfully charged customers prices higher than their lowest advertised price. Beyond the scanner violations, Safeway, Albertsons, and Vons also had issues with inaccurate weights on the labels of their products. Some items sold by weight, such as produce, meats, and baked goods, had less product in the package than was displayed on the package label. For those items, a grocer may only charge for the product’s actual weight, the packaging is not included in the overall weight.

“Shut It Down,” one person posted in a white supremacist chat on Tuesday, hours after Telegram founder Pavel Durov announced he would begin sharing some users’ identifying information with law enforcement.
With over 900 million users around the globe, Telegram has been both revered and reviled for its hands-off approach to moderating posted content. The platform made headlines this summer when French authorities arrested Durov, seeking to hold him responsible for illegal activity that has been conducted or facilitated on the platform — including organized drug trafficking, child pornography and fraud.
Durov has called the charges “misguided.” But he acknowledged that criminals have abused the platform and promised in a Telegram post to “significantly improve things in this regard.” Durov’s announcement marked a considerable policy shift: He said Telegram will now share the IP addresses and phone numbers of users who violate the platform’s rules with authorities “in response to valid legal requests.”
This was the second time in weeks that extremists had called on their brethren to abandon Telegram. The first flurry of panic followed indictments by the Justice Department of two alleged leaders of the Terrorgram Collective, a group of white supremacists accused of inciting others on the platform to commit racist killings.

TD Bank hit with record $3 billion fine over drug cartel money laundering
TD Bank will pay $3 billion to settle charges that it failed to properly monitor money laundering by drug cartels, regulators announced Thursday.
The fine includes a $1.3 billion penalty that will be paid to the US Treasury Department’s Financial Crimes Enforcement Network, a record fine for a bank. TD also intends to pay $1.8 billion to the US Justice Department and plead guilty to resolve the US government’s investigation that the bank violated of the Bank Secrecy Act and allowed money laundering.
The US Department of Justice said in a statement that TD Bank had “long-term, pervasive, and systemic deficiencies” in its procedures of monitoring transactions. The Wall Street Journal first reported the news late Wednesday.

Madison police now say 3 dead, multiple injured in school shooting
Three people are dead, including a suspected juvenile shooter, and at least six others were injured and taken to hospitals after a shooting Monday at a K-12 Christian school in Madison.
Madison police erroneously reported that five people were dead and five were injured during a 12:30 p.m. news conference. They issued two updated news releases after the news conference, saying in fact three people were dead, but they offered conflicting information on the number of injured victims. One release indicated six people were injured, and another indicated seven were injured. A Madison police spokeswoman did not respond to calls.
Just before 11 a.m., police responded to a call of an active shooter at Abundant Life Christian School, 4901 E. Buckeye Road. They found a juvenile dead with a gunshot wound, Madison Police Chief Shon Barnes said. He did not specify the age and gender of the juvenile.
The suspected shooter was a student at the school, Barnes said.
