    First of all, FIBA only gets involved if the player's agent includes the FIBA Standard Arbitration Clause in the contract. (FIBA teams are notorious for leaving it out.) Rumor has it that agents have been compensated by the teams to overlook the missing Arbitration Clause. If the agent doesn't make sure it is inserted, the player has to use the court system in the country where the team is located. Most can't afford that, and the ones that do are usually disappointed with the results.

    IF the contract contains the arbitration clause, the player actually has to pay to have his complaint heard by the FAT. The player is supposed to pay half, but if the team does not pay their half, the player is required to pay both halves before the complaint will even be heard. If the team loses, the case can be appealed to the Court of Arbitration for Sport. Even then, FIBA cannot force the team to pay the player. Their only recourse is, as mentioned, to not allow any international transfers to the team until the amount is paid.

    The fact is, the teams find many ways to get around the rules, and to delay the penalty. One common stall tactic is to challenge whether the player's agent is propery licensed with FIBA. Finally, the decisions of the FAT and the CAS are often simply ignored. It takes a long time before any sanctions are imposed on the team. Many players go for long periods of time without getting paid, and often wind up settling for much less than they are owed, because they need the money.

    And don't forget that the FIBA Arbitration Tribunal was only formed in 2007, and their first decision wasn't rendered until 2008. Before that, players got screwed often, and were almost powerless in the local courts. Here are a few examples:

    Corsley Edwards is currently being screwed by a Chinese team, the Yunan Bulls. We'll see if/when he ever gets paid.

    Jamel Thomas (half brother of Sebastian Telfair, Cousin of Stephon Marbury) played for an Italian team that simply didn't pay him. He won his arbitration hearing, but still didn't get paid. Eventually FIBA issued a penalty, but I'm still not sure he ever got paid. Even if he did, he still had to wait a of a long time for his money.

    Sam Clancy got stiffed by a Russian team. The team claimed "We never got a signed copy of the contract". It worked. The case was dismissed.

    Stevin Smith got stiffed by a Bulgarian club. The team claimed he had hidden a medical condition, and that he "incorrectly stated the name of the club" in his arbitration request. He was awarded partial payment, but the last I heard he hadn't received the money.

    As you can see, FIBA itself says that it does not get involved unless both parties have agreed in writing to submit to the FAT. It also says that both parties "wishing to refer their disputes to the FAT" use a particular arbitration clause in their contracts. Without the clause in writing, and signed by both parties, FIBA doesn't get involved.

    It also says that the player has to put up 3,000 Euros to start the process. (But, if the team doesn't pay its half, the player has to put up the other 3,000 Eu. before the process can proceed.) And finally, if the team refuses to honor the arbitration, the player has the right to pe ion FIBA to penalize them. The penalties aren't automatic. They take time, and more expense for the player. The team can continue to stall for a long time.


    L2 FIBA Arbitral Tribunal (FAT)
    L2.1 General Principles
    L2.1.1 FIBA establishes an independent FIBA Arbitral Tribunal (FAT) for the
    simple, quick and inexpensive resolution of disputes arising within the
    world of basketball in which FIBA, its Zones, or their respective
    divisions are not directly involved and with respect to which the parties
    to the dispute have agreed in writing to submit the same to the FAT
    .
    L2.1.2 FAT awards can be appealed to the Court of Arbitration for Sport(CAS), Lausanne, Switzerland.
