Congress actually addressed this and decided not to contest it. Had they done so and he continued then they would have grounds. They did not so they do not.
Funny, because it's true, but immediately it occurred to me: Bush might have been better.
(Hard to say, since Obama isn't done.)

Bush was the figure of radical change. Obama is continuity guy.
Fully reviving the ancient and estimable practice of outlawry by putting US citizens beyond the law's protection on the President's say so, among other things, has caused me to revisit the question of ranking as between Bush and Obama.
