Don't be so sure. Silver may have ed up. By giving Sterling the 2.5 million fine, instead of the 1 million fine, Silver just admitted Sterling didn't technically violate the league cons ution.
^I'm assuming Larry Coon is a black guy...but at any rate Sterling could be worth 1 trillion gazillion dollars if there's an NBA cons ution in place that dictates terms of agreements for owners and a CBA that players live by this guy has ZERO recourse....he's done like it or not

And why the outrage now? This is the least racist thing Sterling has done. Where was the media coverage ten years ago when he was doing extremely racist things?
I'm not sure. To make it clear: I'm damn glad that Silver decided to do what he did and I will be happy if Sterling loses his team. However, if Sterling decides to take it to the court this thing could go on for quite some time. Sterling is rich as and if he wants to spend his billions for his lawyers, good luck NBA. The biggest concern I see here is the fact that he said it privately. It was taped illegally and then leaked to the public. If Sterling had said/written it himself on youtube, facebook, instagram or twitter it would already be public and the whole issue would be a different story, meaning Sterling would have ZERO chance in court. I'm not 100 percent sure about the legal issues, but doesn't say the first amandment you can say privately whatever you want, no matter how wrong it is morally? Additionally, as far as I know (I might be wrong) evidence cannot be used in court if obtained illegally. And recording in somebody's home is illegal if the person hasn't agreed to it beforehand.
Again, I'm happy that Sterling is now banned from the NBA as there is absolutely no place for racism in here. But I'm not sure how it will stand in front of the court as the taping was conducted illegally.

I think in a league with 30 teams that is probably already over-diluted as it is, having two teams playing in the same city, for the same city, in the same arena, is absolutely re ed. I don't care how big the L.A. market share is.
It's stupid that teams with rich histories like Seattle can't field a team, but California needs 4 ball-clubs with two swapping nights out at Staples.
Same thing goes for the Giants and Jets, tbh.

Article 13 NBA Cons ution: TERMINATION OF OWNERSHIP OR MEMBERSHIP: Ownership may be terminated by 3/4 vote of Govs’ for any of 10 reasons
Only term that applies: (a) Willfully violate any of the provisions of the Cons ution and By-Laws, resolutions, or agreements of the Ass.
This term may apply also: (d) Fail or refuse to fulfill its contractual obligations to the Ass, its Members, Players, or any other third party in such a way as to affect the Association or its Members adversely.
Other than sections A & D I don’t see the other sections applying to Sterling in terms of termination.
Well Sterling is absolutely screwed, I found what I was looking for.
After the 3/4 vote, Sterling will get a notice in writing. He then can & must meet in front of the Board with counsel. He will be allowed to put on evidence of mitigation in an effort to persuade the Board of his position. The Board will listen to all the evidence & vote again.
If the Board votes for termination/sale by 3/4 after hearing from Sterling the vote is essentially final. The decision is deemed final “and each Member and Owner waives any and all recourse to any court of law to review any such decision.”
Article 14 Sec J states in part “..each Member and Owner waives any and all recourse to any court of law to review any such decision.”
This means Sterling has waived his right to sue in court over the forced sale. So now we know he has waived his rights in both ban & sale.
Once Sterling is officially ousted the Commissioner shall be in full control and management of the team. The Commissioner shall make ALL decisions for the team. Including liquidation and or sale.
Article 15 Alternative to Termination: With a 2/3 board vote, the Board may waive termination & invoke a fine (no cap on the fine).
After a quick review of the NBA by-laws the Board has very broad powers to terminate ownership & Sterling has waived his right to sue. What this means is Sterling has to persuade a Judge to set aside this clause of the by-laws in order for Sterling to sue. Uphill battle.
Again, must view the Ban & Termination of Ownership as two different events & in both events Sterling has waived his right to sue.
Also, there is NO arbitration clause Sterling can take advantage of. In relation to the ban, the bylaws name Silver as the arbitrator.

Sterling bought it for $15 million. Franchise could easily sell for $1 billion. That's a staggering amount of profit for someone who made absolutely zero effort to build the organization.

The problem is that they even chose to sign with the Clippers in the first place..everybody has known that Sterling is a racist and a slum lord for over 15 years..I understand that low-level players may not have had opportunities with other teams, but guys like Tom Rivers and Chris Paul could have signed with any other franchise, but they chose the franchise owned by a reputed bigot and slum lord..sad, tbh..
in contract law u can always rescind a contract if both parties come to an agreement, if they want to walk out without any remittance from the employer, then so be it...walk out and sign somewhere else, thats how it is in the real world if u want out...

I don't recall any official vote taken place yet and the Donald said he is suing for $1.7 bill. If he wins the lawsuit (and that could happen)
how much will each owner have to pony up to pay. (don't forget legal fees also)...This is far from over and the victory lap that some
are taking could be disappointed. They can take away his franchise buy vote but who puts the value on it. $1 bill? $2bill---then the lawsuit.
