    I'll be very interested to see how the District Attorney handles this, particularly in light of the video evidence. Pretty hard to justify that sort of use of force with a suspect who is 20 feet away, standing still, with his hands in the air. Even if he was armed at the time with a knife (I've heard conflicting reports on that issue), he's not much of an imminent threat to the officers' lives absent some other effort on his part.

    I think that's my ultimate quarrel with so many of the officer-involved shootings of late -- the use of lethal force in cir stances that don't dictate its use is making things harder on cops than they should be. Most police officers are wonderful and brave people and to see those professionals pilloried and threatened because other fools in their midst don't know the rules of the road in policing is outrageous. At that, lethal force now seems to be the solution to a lot of difficult encounters for police, which suggests to me that either they are being trained to use lethal force on the regular or they just aren't abiding by their training. Lethal force is appropriate sometimes, but not when the suspect manifestly poses no threat to the officers.

    When cops appear to act beyond their authority, I think the most anyone can reasonably ask for is accountability. If an unbiased investigation shows enough to take the case to the grand jury, then let the case go forward like any other grand jury proceeding -- without being tilted unusually in favor of any particular outcome -- and let the judicial process sort out the merits. I'd be surprised, given the video, if these deputies aren't taken before the grand jury at some point, but a thorough investigation might reveal something not apparent on the video that will give the officers some justification; the optics of this video make the case look pretty bleak for those deputies, though.

    I'm not sure about how a civil case against the BCSO or the cops would go down, though I think it's almost certain to settle short of a trial. If it were to go forward, those sorts of cases tend to be difficult to prove and the officers tend to get a lot of protection from immunity laws, though that immunity has limits when you start getting into provably excessive force (the recent case against the Incarnate Word officer who shot and killed a kid is bogged down in fights about immunity and such). Also, a jury in that sort of case in Texas also gets to apportion responsibility for the shooting and death between the officers and the decedent, and given what was going down before the shooting (reportedly), I'm not sure that the decedent or his family would be likely to get overwhelming sympathy from a panel of Bexar County jurors. I'm also not 100% sure that the video is admissible, but if it would come in at a trial it would certainly be almost anyone's Exhibit 1.

    Domestic disturbance, he stabbed or cut the chick while she was holding an infant, the video shows the finale to a 20 minute struggle with police in which tasers were used but his blubber apparently gave him taser protection.

    Still doesn't look like they had to kill him.
