There's not a clear line, but there is a key distinction: black ops are generally actions of a government or the military not attributable to the same.
Trump qua private citizen (which as a candidate, he was) using a private intelligence firm to dig for dirt on political opponents isn't in the same category as the USG or the US military doing it.
