a dead body cannot give consent. a dead body cannot do anything. a dead body is dead. a dead body also is not a person. a dead body might be sacred, but that doesnt mean it is en led to the SAME privileges as a living human being.
there should be a law about ing dead things. there might even be a law prohibiting that in wisconsin. but third degree sexual assault is NOT that law. assaulting someone or something without their consent implies that they could possibly give consent, which a dead body obviously cannot do.
now there ARE laws prohibiting bestiality in most (but not all!) jurisdictions, and those laws deal with the problem of an animal being unable to consent or not consent to a sexual act. they also have a special set of punishments designed just for that offense.
but i guaran- ing-te you that the people who drafted the sexual assault law and its attendant punishments did NOT contemplate necrophilia. no way.
there needs to be a specific law. it needs to spell out the offense in appropriate terms. and it needs to have whatever punishments attached to it that WI thinks are fair and just. but 3rd degree sexual assault is NOT that law.

Morbid as it is, that's actually a good point. You can have a set of laws specifically about desecration of the dead. But you shouldn't be able to use an offense designed to protect the living. Otherwise, to carry it to an absurd extreme, you be charged with a crime against somebody's cremated ashes.

This section applies to whether the victim is dead or alive at the time of the sexual contact or sexual intercourse.
There is no law making necrophilia illegal in Wisco, hence the sexual assault charges.
glad that law exists. the question remains, how does a dead person consent or not consent to sex? and should the same punishment that applies to a live victim apply to a dead "victim"?
They didn't make that law with logic in mind. There was a loophole that was seen as an expeditious way to make it a crime.

i did a little bit of research and discovered that the likely reason the "death of the victim" section was added into the model penal code was because people were using the defense that in the course of their sexual assault, they killed the victim, and engaged in sexual conduct with the corpse after the death. to close up this loophole, they added the section in that it doesn't matter if the person is dead or alive. therefore, i still doubt that WI lawmakers thought this law was going to apply to necrophiliacs as opposed to rapist-murderers who were just "lucky" enough to have their victim die before they raped them.
many states (but not WI) have an actual necrophia law. these laws specifically mention necrophilia, so that they may not be used to get convicted of a lesser crime when someone kills then rapes someone.
i guess its not so clear that these kids will beat the sexual assault rap. but their defense attorney will have a good argument that a different sentencing standard should be applied
