If she was compelled into intercourse without her consent, it might be rape or sexual assault, or even for simple assault or battery, but that would assume that you could prove she hadn't consented -- a tough thing to do.

Well, that's what I'm saying -- if she consented to that type of a marriage and hasn't really done anything to extricate herself from it (and particularly if she's not said or indicated that he can't have intercourse with her or that she won't have intercourse with him) then there's essentially no basis for any of those charges.
Our court system has failed us again. Bush needs to get his head out of his ass and instead of focussing on Gay Marriage, he first needs to deal with our very own court system.
