    EPA public affairs official given right to veto federal grants if they mention climate change

    Scientists and university researchers who are seeking grants from the Environmental Protection Agency are unlikely to see any funding come their way if they mentions the dreaded double-C words: climate change.

    According to the Washington Post, the EPA has given veto power over grants and awards to John Konkus, who goes by the le of Deputy Associate Administrator for Public Affairs.

    The Post notes that the EPA doles out hundreds of millions of dollars in funding and that those dollars are, in essence, only given with the approval of Konkus now.

    Konkus has reportedly told staffers that he is empowered to look for “the double C-word” — climate change — and warned grant officers that they not to be mentioned in funding solicitations.
    The report states that Konkus has already canceled close to $2 million awarded to universities and nonprofit organizations.

    The US Air Force (USAF) has maintained a series of defense weather satellites with microwave imaging technology since the 1960’s.

    most of the existing F series satellites have exceeded their design lifetime and no replacements are in sight because

    Mike Rogers, chairman of the House Armed Services strategic forces subcommittee,

    forced the Air Force to destroy the F-20 satellite which had already been built and was scheduled for launch.

    Multiple satellite units had been built at the same time to save money on building them but storing the F-20 cost millions.

    He eliminated funding for launch and for storage giving the Air Force no option but to destroy the satellite.

    The premature failure of the F-19 satellite has created a potential situation where

    there will be a dangerous gap in microwave satellite imaging capabilities because Mike Rogers destroyed the F-20.

    Mike Rogers asserted that the technology was obsolete but it provided a continuous record with the same kind of sensor of the long decline of sea ice extent in the Arctic.

    “It's a real loss to have had the F20 dismantled, but Congress would not give the Air Force the funds to launch that sensor even though the instrument had already been built,” Julienne Stroeve, a remote sensing expert at NSIDC, said.

    The Japan Aerospace Exploration Agency operates the fourth Arctic-monitoring satellite. That’s also approaching the end of its forecast five-year lifespan. Stroeve said NSIDC is working to integrate data from the Japanese satellite into their operations, “but even so there may still be a gap for a couple years.”

    The European Space Agency is expected to launch an new satellite to monitor the region, but the launch isn’t on the docket until 2021.

    Rogers seemed angry that the Air Force’s F satellite series was collecting key data that proved that dangerous warming was taking place in the Arctic.

    He accused the Air Force of incompetence.

    Instead, he said, the money set aside for DMSP could have been spent on other national security priorities, but now

    the satellite is “going in the trash. I presume it’s going to be made into razor blades.”

    lawyers for the Department of Labor said, signaling that the government will offer an out for brokerages that would have been subject to class action lawsuits.

    Thrivent Financial, a Minneapolis-based asset manager, has asked a federal court in Minnesota to block an anti-arbitration provision in the government’s fiduciary rule.

    The provision allows unhappy clients to sue their brokers, a first in an industry which has always required customer disputes be arbitrated.

    In a brief filed last week, Labor Department lawyers wrote that their agency’s actions on the fiduciary rule “in the near future are likely to moot this case.”

    “The department has stated its agreement with the plaintiff that the challenged provision is improper as applied to arbitration agreements,” the Labor Department said in its filing.

    The Labor Department crafted the fiduciary rule during the administration of former President Barack Obama to require financial advisers to act in their customers’ best interests.

    A bill that would very deliberately undermine the protections afforded under the Americans With Disabilities Act (ADA) could come to a vote in the US House of Representatives soon.

    This is how the new bill would look:

    If someone in, say, a wheelchair comes to a movie theater without a ramp or elevator, they would be required to give the business owner a written notice.

    Then, the business owner would have two months to respond and another four months to take some steps to address the violation.

    Only then, half a year later, could the person whose rights are at stake try to force the business to comply with the ADA and be held accountable.


    This new bill would incentivize businesses dragging their feet to comply with the ADA’s accessibility obligations.

    It would also act as a profound deterrent to people looking to enforce their rights under the ADA.

    Already under existing law, the onus is mostly on them to trigger enforcement and accountability.

    Under H.R. 620, that burden would be compounded by months of delay and new bureaucratic hurdles.

    Many people would likely give up rather than put themselves through all that – and perhaps that’s exactly the point.

    The United States has the obligation to ensure businesses do not discriminate against people with disabilities. Yet

    H.R. 620 would actually create more obstacles for them to access justice.

    EPA Rewrites Rules Limiting Water Pollution from Coal Plants

    Revised rule postpones compliance deadlines for critical pollution safeguards

    Today, the Environmental Protection Agency (EPA) announced that it is taking further action to delay critical public health protections for cleaning up toxic water pollution from power plants.

    EPA first began efforts to roll back the power plant wastewater standards in April, when EPA Administrator Scott

    Pruitt suspended important limits on the amount of toxic pollutants such as arsenic, mercury, and lead that power plants are allowed to dump into our waters.

    The EPA action announced today would make a two-year delay of those public health protections a new part of federal regulations.

    During that two-year period, EPA intends to review the public health protections at industry’s request to consider further delaying and weakening them.


    A coalition of public health and environmental groups, represented by Earthjustice, has been fighting in the courts to oppose the new EPA Administration’s attempts to delay and weaken the power plant toxic water rule.


    “Coal-burning power plants are the number-one source of toxic water pollution in this country,”

    said Earthjustice attorney Thomas Cmar.
