    The Trump administration has rescinded its decision to cut off legal aid for unaccompanied immigrant children, just three days after it ordered government-funded attorneys across the country to immediately stop their work.

    The Acacia Center for Justice and the Immigrant Defenders Law Center (ImmDef) confirmed that the stop-work order affecting non-profits that provide legal counsel for about 26,000 unaccompanied minors had been lifted.

    Trump’s migration-as-invasion theory permeates his executive orders and other pronouncements on immigration. But he is not just using the frame to try to exploit inapplicable wartime laws and cons utional authorities, as damaging as that is. In at least one of his orders, he is also using it to lay claim to vast presidential powers that don’t exist in peacetime or wartime, launching a direct assault on the cons utional separation of powers and the rule of law.

    To begin, one of Trump’s Day One orders tees up a potential invocation of the Alien Enemies Act of 1798, a wartime law that can be invoked in times of “invasion.” The Act was last used in World War II to intern 31,000 noncitizens of Japanese, German, and Italian descent without due process. (U.S. citizens of Japanese descent were interned under a separate authority.) If Trump invokes the law—and if the courts uphold his invocation—it could empower him to summarily detain and deport foreign nationals who are lawfully present in the United States and have no criminal history.

    This would be a clear abuse of the law. As explained in a recent report from the Brennan Center (where we work), the Alien Enemies Act’s powers are available in response to a literal armed attack, not a figurative or purely rhetorical “invasion.” The language and structure of the law, as well as the congressional debate over its enactment, leave no doubt on this point; the law refers to acts of “actual hostility” and was intended to implement the law of war. The law has been used only in times of declared war or, during World War II, in the immediate wake of Japan’s attack on Pearl Harbor.

    Trump's real war is on the American people

    In another Day One executive order, Trump directed the Secretary of Defense to assign a new mission to NORTHCOM, the combatant command for the U.S. armed forces in the North American continent: “repelling forms of invasion including unlawful mass migration, narcotics trafficking, human smuggling and trafficking, and other criminal activities.” The order directs NORTHCOM to plan a “campaign” for accomplishing this mission. It cites no specific statutory authority; instead, it notes the president’s “solemn responsibility” as “Chief Executive” and “Commander in Chief of the Armed Forces” to protect “the sovereignty and territorial integrity of the United States.”

    Here, Trump appears to be relying on a longstanding and widely accepted interpretation of the Cons ution under which presidents have inherent cons utional authority—and can act on a temporary basis without congressional authorization—to repel invasions of the United States. Like the Alien Enemies Act, however, this power is reserved for armed attacks. During the Cons utional Convention, the Founders explicitly referred to this presidential prerogative as “the power to repel sudden attacks” or “repel and not to commence war.” Nothing in the Cons ution remotely contemplates a presidential power to direct a military campaign against civilians entering the country without do entation.

    Trump’s executive orders are unprecedented in many respects. Nonetheless, there are some lessons we can learn from history. This is not the first time that a president has falsely claimed an “invasion” across the southern border. In 1846, President James Polk proclaimed that Mexican forces had “passed the boundary of the United States” and “invaded our territory and shed American blood upon the American soil.” Within two days, he secured a congressional declaration of war.


    Although Polk correctly identified the elements of an “invasion”—armed hostilities that require the government to meet force with force—he lied about the facts. Two years later, when the truth came out, then-Representative Abraham Lincoln charged that Polk had “unnecessarily and uncons utionally” secured a war authorization through misrepresentation. Led by Lincoln, the House of Representatives passed language to censure Polk for unlawfully proclaiming an “invasion” to aggrandize presidential power.

    The US Department of Justice is now investigating and threatening to prosecute the sheriff for failing to cooperate with ICE, though it’s not clear what the department would charge him with.
    The sheriff’s office said Osborne “acted consistently” with state and local policy, didn’t interfere with federal law enforcement, and told ICE when the man was going to be released.


    “From what I can tell, the sheriff did not violate any law,” said Estelle McKee, a professor at Cornell Law School in Ithaca who specializes in immigration.

    A federal judge in Maryland blocked the Trump administration on Monday from carrying out immigration enforcement actions at certain places of worship for Quakers, Cooperative Baptists and Sikhs, who filed a lawsuit challenging President Trump's unwinding of a Biden-era memo that barred immigration arrests at certain protected locations.


    U.S. District Judge Theodore Chuang granted a request for a narrow preliminary injunction sought by the religious groups as they pursue their challenge to Mr. Trump's directive allowing federal immigration authorities to conduct enforcement actions at places of worship. Chuang's order does not block the administration's policy nationwide, and only applies to houses of worship owned or used by the challengers — the Quakers, the Cooperative Baptist Fellowship and the Sikh Temple.


    The groups had argued that the new policy allowing immigration arrests at places that were previously considered protected violates their First Amendment rights and burdens the free exercise of religion under federal law.

    New Mexico teachers unions are raising concerns over reports that federal agents boarded a school bus carrying student-athletes and asked for proof of citizenship.

    The incident reportedly took place at around 7:15 Friday morning at a U.S. Border Patrol checkpoint on Interstate 25 north of Las Cruces. According to school officials, agents stopped a chartered bus transporting Las Cruces High School’s swim team to a compe ion in Albuquerque. Witnesses say agents boarded the bus and requested do entation from the students, speaking in Spanish. The team’s coach, Pamela Quiñones, intervened, explaining that the students spoke English and were part of the school’s swim team. The agents then left the bus without further questioning.

    “Without hesitation he jumped on the bus and didn’t ask the adults any more questions,” Quiñones told Heath Haussamen of Haussamen.com. “He just started walking in the bus and started yelling in Spanish, demanding do entation from all the passengers.”

    Students, she said, were left clearly rattled and confused by the experience.
