    They were Republican Arizona’s golden boys, the plain-spoken, get-tough sheriff and his legal and political foil, Sheriff Joe Arpaio and attorney Andrew Thomas. According to a post at Talking Points Memo, Thomas “might have had a bright career in Arizona politics,” but instead is today facing disbarment, criminal charges and professional disgrace.

    In his six-year reign as Maricopa County’s top prosecutor, Thomas and Sheriff Arpaio went on a legal rampage against their perceived political enemies, drumming up and pursuing criminal charges that they knew were false, charges that rarely held up under scrutiny. As a result, say investigators, Thomas “undermined the public trust and inflicted great damage to the system of justice. The only way to restore that trust and to repair the damage to the system is to disbar Thomas.

    Those remarks came at the end of a two-month investigation last year that implicated Thomas as well as two aides, Lisa Aubuchon and Rachel Alexander, whose law licenses are also in jeopardy. Thomas’s attorneys have called the investigation a partisan witch hunt, even quoting the film “Monty Python and the Holy Grail” in their final filing on behalf of Thomas in December.

    “We found a witch,” they wrote, purportedly speaking as the public officials who filed charges against Thomas, “May we burn her?”

    Arpaio admits he ignored court orders, will apologize for racial profiling and create a fund to compensate people whose rights he trampled. Whether he can avoid criminal referral by doing so will be up to a judge.

    Now other law enforcement officials in Arizona are criticizing Arpaio as well. One is the former assistant police chief of El Mirage, the Phoenix suburb from which many of the allegations stem. The town’s police department disbanded in 2005 for a two-year period, and its cases were temporarily transferred to the Maricopa County Sheriff’s Office. When the department reorganized, it found Arpaio hadn’t followed up on the child molestation cases. Former Assistant Police Chief Bill Louis called the mishandling “apparent gross negligence.” That many of the alleged victims are children of immigrants should surprise no one.


    All Arpaio has been able to muster is a meek reply. “If there were any victims, I apologize to those victims,” he has told media. Then he tried to claim that Democrats were out to get him. It’s a political hit.


    Enough evidence exists that Republican Sens. John McCain and Jon Kyl felt moved to comment. “Victims of abuse not only deserve the respect of law enforcement, but their rights must also be protected throughout the criminal process,” a statement released on behalf of both senators said.

    Arpaio's office has a history of investigating his opponents. Two elected county supervisors and a judge were among those investigated and charged with crimes in the past decade after feuding with the sheriff's office.

    The Justice Department has filed a lawsuit against the sheriff to look into abuse-of-power allegations over the political feuds.

    looks bad for Arpaio, IL. abuse of power charges would put him in very small subset of lawmen. as an LEO, Arpaio is probably toast if it's found he instructed others to ignore court orders.

    "The Cons ution simply does not allow states to order federal officials to do anything. Under our Cons ution, federal law is “the supreme law of the land,” so when Congress enacts an otherwise valid federal law and empowers federal officers to enforce it, the states have no power whatsoever to limit that enforcement or place conditions on it.

    Disturbingly, the bill may also be connected to a radical anti-government group known as the “Oath Keepers.” The Oath Keepers is a right-wing group that pushes local law enforcement to pledge to defy federal “orders” the Oath Keepers believe are uncons utional. Their website is riddled with paranoid rhetoric about government officials “disarm[ing] the American people,” “confiscat[ing] the property of the American people, including food and other essential supplies,” and “blockad[ing] American cities, thus turning them into giant concentration camps.”

    In early 2008, the Oath Keepers’ founder warned that a “dominatrix-in-chief” named “Hitlery Clinton” would impose a police state on America and shoot all resisters. After Democratic primary voters chose President Obama over Clinton, the Oath Keepers simply rewrote their paranoid fantasy to include a taller, African-American lead. Rep. Gowan, the lead sponsor of this bill, is listed as a member of the Tucson Oath Keepers on their Meetup page."

    I don't know if Arpaio is an Oath Keeper, but that's sort of what I meant when I joked about contempt of court and abuse of power charges being listed as qualifications on Arpaio's next resume, somewhere.

    bad justice is expensive. Fox News Latino reports:

    The $45 million price tag consists of: $14.6 million spent over the last 18 months to carry out court-ordered changes at the agency; another $23.8 million budgeted over the next year to cover even more compliance costs; and $6.8 million in fees for lawyers on both sides.


    Taxpayers are expected to face even more costs as Arpaio's office remains under the court's supervision and the possibility looms for another racial-profiling trial that the county will have to fund.

    Withh his legal fees mounting and a trial turning increasingly personal, Maricopa County Sheriff Joe Arpaio is turning to the public for money and the legal system for a new judge.


    Arpaio said in a letter to supporters that he doesn't have the money to continue paying for attorneys out of his own pocket, adding that he feels "targeted" by the immigration rights groups that have sued him to stop what they say are racist policies targeting Latinos.

    "In some instances I have to personally pay for attorneys to represent me in these cases," Arpaio wrote in an email Thursday. "I do not have the personal wealth or the wherewithal to keep up with the costly demands of paying for attorneys to defend me."

    Arpaio made the plea while awaiting a decision by U.S. District Judge G. Murray Snow on whether the sheriff broke the law in failing to carry out a 2011 court order to refrain from bias against minorities.

    In an angry rebuke, a judge on Friday ordered the U.S. Marshals Service to seize a collection of records from Sheriff Joe Arpaio's office and leveled harsh criticism at the sheriff's lawyers for failing to turn over do ents that had been requested months ago in a racial profiling case.
    U.S. District Judge Murray Snow's criticism centered on the agency's failure to hand over more than 1,400 identification do ents in a related investigation into allegations that deputies pocketed items during busts.
    The judge also focused on the agency's refusal to turn over 50 hard drives from Arpaio's secret investigation involving the judge.


    Arpaio attorney John Masterson said an official who is monitoring the sheriff's office on behalf of Snow had resorted to threatening to have a court hearing called in a bid to get the records turned over.
    "I am sorry your feelings are hurt, but we need to resolve this matter," Snow told Masterson at an emergency hearing Friday.


    Robert Warshaw, the official monitoring the sheriff's office for the judge, said he learned the ID do ents were slated for destruction and that there was an order at the sheriff's office that the existence of the ID records shouldn't be voluntarily revealed.


    The court monitor said the unit of the sheriff's office that stores evidence is a lockbox for keeping unflattering do ents from public or court scrutiny.Arpaio didn't attend the hearing. The sheriff's office declined to comment on Warshaw's comments, saying only that the truth of the matter will be revealed in the future.


    Warshaw is examining allegations that members of Arpaio's immigration smuggling squad and other deputies regularly pocketed items from people during traffic stops and busts of safe houses used during smuggling. The judge has complained that Arpaio'soffice is conducting inadequate internal investigations of officer misconduct.


    The 1,400 ID records were turned in by a sheriff's sergeant who claims he had them to help teach a class on fraudulent identification, Warshaw said, noting the sergeant never in fact conducted such training.


    Warshaw said he tried to find out who at the sheriff's office issued the order not to voluntarily reveal the IDs but was told that information was protected by attorney-client privilege.


    "We did not lie to the monitor or keep that from the monitor," said Arpaio attorney Michele Iafrate.


    The court monitor also is examining Arpaio's secret investigation involving the judge, who dealt Arpaio one of his toughest legal defeats in 2013 when he concluded deputies had racially profiled Latinos.


    Snow has said the investigation was intended to show an alleged conspiracy between him and federal authorities who are pressing a separate civil rights lawsuit against the sheriff.


    Arpaio, who in the past has been accused of retaliating against his critics, insists there were no investigations of Snow.

    It isn't the first time Arpaio's office has been accused of withholding do ents in the profiling case.


    Earlier this year, Arpaio acknowledged a contempt-of-court violation in failing to hand over traffic-stop recordings that had been requested before the 2012 trial.


    Five years ago, the agency acknowledged that its officers had deleted emails on the sheriff's immigration patrols and destroyed officers' records of traffic stops.


    Arpaio initially failed — but was eventually forced — to turn over his own personal immigration file that included letters from supporters who sought crackdowns on day laborers.
