HB 3287 requires breweries to sell their beer to a distributor then buy it back to sell it in the taproom. It applies to breweries who make more than 225,000 barrels of beer per year.
Local breweries say state lawmakers are hurting the smaller businesses.
"You basically have to pay a fee or a tax to be able to sell our own beer that we make on premise at our taproom at our own facility. In another industry, you'd call it a shakedown," said Adam Debower, co-owner of Austin Beerworks.
Texas is currently the only state that does not allow breweries to sell their product to customers on site for off-site consumption.

Sen. Dawn Buckingham (R-Lakeway) and Rep. Eddie Rodriguez (D-Austin) had previously introduced companion bills SB 312 and HB 672, respectively, advocating in the breweries' favor. They plan to introduce subs ute bills that include the agreed upon limit soon, according to a statement.

Tour average beer manufacturer doesn't have the diverse portfolio of packaging options of a Coca-Cola, and those breweries heavily invested in aluminum packaging will have no choice but to raise prices.
Microbreweries in particular will be hard-hit. These smaller outfits lack the deep pockets of name-brand breweries, and being on the crunchier side of the market, have largely shifted to aluminum over bottles for environmental reasons. They also use tanks, kegs and brewing equipment made of steel, which is also subject to the new tariffs. They will need to raise costs in order to survive.
