The ultimate issue for the courts to decide is whether Donald Sterling was acting in his official capacities as an owner when the statements to his girlfriend were made. i highly doubt those statements were made during a game; obviously they were privately recorded conversations. Also, an underlying issue is whether it hinders his effectiveness as an owner: it can be argued both ways - others can say that by preventing black people form going to his games, he's hindering the NBA (which is true). But on the other hand, he just told his girlfriend not to bring black people to his games, not everybody else. His ability to get black players to play for the team shows that it hasn't hindered his judgment in acting as an owner.

With all that being said, Sterling probably wouldn't want to keep the franchise now that his image is completely tarnished. His best bet is suing or settling with the NBA; I'm pretty sure NBA's going to have to fork over a ton of money to him either way.

Humans have to make up their minds on racism. If you a racist but do not act on your racism, should your life be spared? Or racism a death sentence? I think people need to look in the mirror first before they start throwing stones and wanting to burn people at the stake.
