    Is a guy backing away a lethal threat? Yes or no.

    they can both be lethal threats - depending on the attorneys presenting the case in a trial

    mace can incapacitate you long enough to have your gun taken away and shoot you dead- so you can NEVER allow yourself to be incaapacitated by a suspect for fear of being killed with your own weapon

    and the maga was reaching for his waist (if the report is correct) so any person working in a official capacity as a peace officer or as a qualified security agent is allowed to use ldeadly force to save his own life or the life of others


    if the attorneys are skilled he will be justified in self defense

    Typical law enforcement defense statement would claim shooter was forced to discharge their firearm as mace would have incapacitated them and the other person would be able to take their firearm.

    The magarard was the aggressor and showed intent to harm the shooter.

    This will be seen as self-defense by the DA.

    No. Mace isn’t a lethal threat and guy with mace was backing away when he drew his weapon. Security guy is ed.
    He assaulted the security guard before macing him.
