    Congress doesn't determine that all on its own anymore, I don't think it still has a jail.

    A criminal referral to DOJ is just a suggestion. If there's a dispute about the validity of the subpoena, that will almost surely be allowed to play out first.

    No, it isn't. Not to lock him up immediately. The commission has no legal authority to jail anybody.

    As the quote properly states, they will refer for prosecution (purportedly to the DOJ).

    This goes to a court, Bannon will make his case, and only after that entire process he might face jailtime.

    People don't just lose their due process rights because Congress says so.
