The thing is she wants to file and claim her to get the money and screw me. I dont really think she has to file but my question is can she? based on that amount and that there was not federal withheld.

If they didn't take out taxes, then she won't get anything back. The child exemption is credited against what you paid to the government in taxes. They don't just give her that amount of money for the child. Is that what she thinks?

Yeah she is nuts, she doesnt even have a job right now and wants to move out and take my daughter with her. She might have found a job with her dad yesterday but, I dont know that it is a "stable income" to support my kid.

Im thinking of just filing married/separate and claim my daughter and screw her . I dont think she is en led to that money. She needs the money for a warrant anyways so if she does not pay that she will be in jail.

I just did it in Turbotax real quick....she'd get an EIC refund of $94 dollars. Not the thousands I'm sure she's anticipating. I hope she didn't write checks against it already.

If you've gotten big refunds in the past (due mostly to child AND EIC credits) that may be what she's thinking she'll get just because of your daughter. I guess she's not realizing you actually have to work and put in to get any back ... even if what you get back is more than you put in. There still as to be an effort in there somewhere.
