    Maryland’s Democratic senator Chris Van Hollen says the government of El Salvador has denied his request to visit Kilmar Ábrego García, his cons uent who was wrongly deported to the Central American country last month.

    “I asked the vice-president if I could meet with Mr Ábrego García. And he said, well, you need to make earlier provisions to go visit Cecot,” Van Hollen said. “I said, I’m not interested at this moment in taking a tour of Cecot, I just want to meet with Mr Ábrego García. He said he was not able to make that happen.”

    underrated: US support for Bukele's shady deal with MS-13

    Bukele was elected in 2021, winning on a platform that promised to (once again) “crack down” on gang violence. But his party, Nuevas Ideas, did so with the support of a critical group: Yep, MS-13. Prior to the election, Bukele and his party negotiated with the gang to bring back the “truce,” which would include (according to the federal indictment) “financial benefits, control of territory, the ability to run the gang from prison, and the early release of gang members.” MS-13 also wanted assurance that they wouldn’t be extradited to the U.S., where they would face more punitive measures. (Having studied the drug cartels in Colombia, this was reminiscent of Pablo Escobar’s mantra, “Mejor una tumba en Colombia, que una carcel in los Estados Unidos” – which means, “Better a grave in Colombia than a jail cell in the United States.”) The same day he took office, Bukele removed the Attorney General and five members of the Supreme Court who had been working with the U.S. to take real action against MS-13. He also released a major MS-13 leader whom the U.S. was seeking for extradition from prison.

    In exchange, MS-13 “agreed to reduce the number of public murders in El Salvador, which politically benefitted the government, by creating the perception that the government was reducing the murder rate.” Indeed, Bukele’s popularity is the result of his so-called “Territorial Control Plan,” which involved building his supermax prison and his plan of mass incarceration – a plan which he credits for the drop in violence since he took office. Of course, the citizens of El Salvador aren’t privy to the secret negotiations Bukele made with MS-13 – details that were going to be made public when the U.S. government’s case against the MS-13 defendants went to trial. Which may explain why the Trump administration quietly dropped these charges last week and put the charged MS-13 members on the third plane bound for El Salvador (and which included Abrego Garcia). Among the defendants was one of the highest-ranking leaders of MS-13, Cesar Humberto Lopez-Larios, who was arrested last June and added to the earlier indictment (and who almost certainly will not face real punishment in El Salvador). A former FBI agent who spent years working on this and other gang cases called it a historical loss,” especially in terms of getting critical intelligence about MS-13’s operations and members in the United States.

    In short, both Trump and Bukele appear to be complicit in a plan to allow MS-13 to operate in El Salvador on its own terms, in exchange for making it look like both are “cracking down” on the gang in their respective countries. Of course, the fact that MS-13 will continue to operate in cahoots with the El Salvadoran government means that citizens of that country who are victims of the gang will continue fleeing to the United States, undercutting the Trump administration’s claim that it is trying to end the “invasion” of asylum seekers. Then again, Trump needs a steady influx of people to continue trying to cross the border in order to keep claiming the “national emergency” he is using to expand his authority. So it’s a win-win propaganda operation.

    Are these details explicitly mentioned in the agreement Bukele and Trump have come up with? (You’d think they wouldn’t be, but then again we’re talking about an administration that invited a journalist into a Signal chat discussing classified war plans.) Maybe not, but to the extent they mention the release of specific MS-13 members who have already been indicted by the Justice Department, the Trump administration may be hoping to avoid closer scrutiny of why it is suddenly dropping the charges.


    As I mentioned, that could be just one reason the Trump administration doesn’t want to reveal the details. The other reason is that the deal as written simply undercuts the Trump administration’s legal claim that it can’t do anything to secure Abrego Garcia’s return. The AP has quoted internal memos from El Salvador’s Ministry of Foreign Affairs, which states that the country will “house these individuals for one (1) year, pending the United States’ decision on their long term disposition.” Meaning that the U.S., not El Salvador, is in control of what happens to the people sent there – undercutting recent claims made in court by the Justice Department that they are being held under the “domestic, sovereign authority” of El Salvador.

    ICE sent Andry Jose Hernandez Romero to a torture gulag based on double hearsay evidence attested by a bad Milwaukee ex-cop on a Brady list -- and apparently nothing else

    Outsourcing gang identification may speed up the deportation process, but as we've already seen, the moral price is quite high in the absence of due process


    Andry Jose Hernandez Romero — the gay Venezuelan makeup artist the DHS shipped off to an El Salvador prison — was declared a gang member by the extremely dubious assertions of a Milwaukee, Wisconsin ex-cop who was such a terrible cop, he’s now reduced to working for private prison company, CoreCivic, which hired him only four months after he resigned rather than be fired by the PD.

    A disgraced former Milwaukee cop with credibility issues helped seal the fate of a gay Venezuelan makeup artist sent to El Salvador’s notorious prison, according to do ents reviewed by USA TODAY.

    A report approved by the police-officer-turned-prison-contractor claimed the Venezuelan man was a member of the notorious Tren de Aragua gang.

    But the credibility of Charles Cross, Jr., who signed the report, was so bad, prosecutors flagged him on a list of police who had been accused of lying, breaking the law or acting in a way that erodes their credibility to testify in Milwaukee County.

    Former officer Cross was fired from the Milwaukee PD in 2012 for crashing his car into his own home while intoxicated. At the time, Cross was also being investigated for overtime fraud and had already racked up enough misconduct charges that Milwaukee County prosecutors placed him on the “Brady List” — a list of all law enforcement officers the prosecutor’s office felt presented serious credibility issues.

    That string of events ended Cross’s law enforcement career, but he’s managed to find a way to keep ing people’s lives up while working within the confines of the private sector.

    Today, Cross, 62, is one of the private prison contractors helping to identify Venezuelan migrants as members of the criminal outfit Tren de Aragua – a designation that’s landing them in a Salvadoran prison without due process.

    Entrusting private contractors – and not federal agents – to determine whether migrants are members of a criminal gang adds a new level of apprehension, migrant advocates and a former ICE official said.

    The do ents obtained by the Milwaukee Journal Sentinel show Cross made this determination. Whether or not he acted alone is still unknown. The DHS refuses to answer questions about this case, as does CoreCivic. The only other name on the report that turned Andry Romero into a gang member is Arturo Torres, another employee of CoreCivic.
