90% have been released without any charges, most of them by George W. Bush.

    What's your take on that?

He'd have to wait to see what Trump says.

Gitmo is and always was a psyop

The point of the Guantanamo camp was never that some immigrants were too dangerous to remain stateside. It was to *give the impression* that such dangerous immigrants existed and had been detained — which is exactly how Guantanamo was used after 2001.

Nashiri is the alleged mastermind of the USS Cole attack in 2000, a really bad guy

His lawyers are claiming that DOGE has caused ins utional chaos and that their superiors have coerced and threatened them for doing their jobs

Obviously, the military commission process is still struggling to proceed to a verdict

I thought that was an inside job. A bunch of soldiers lost their enlistments over it.

good going torture and military commission stans

KSM is probably unprosecutable even in a military commission -- 25 years later -- because we tortured him

In a major blow to the U.S. case against Khalid Shaikh Mohammed, the man accused of plotting the Sept. 11 attacks, a military judge ruled on Friday that the prisoner’s confessions to F.B.I. agents were not voluntary and cannot be used against him at trial.

Prosecutors have described Mr. Mohammed’s interrogations in 2007 at the U.S. Navy base in Guantánamo Bay, Cuba, as the government’s most crucial evidence in the long-running death-penalty case.

But his confessions have always been challenged because the government used torture to question him in secret C.I.A. prisons years before he was charged.

The ruling, just before the 25th anniversary of the attacks, could further delay the start of a trial if prosecutors decide to appeal to reinstate it. Aging survivors and families of victims have said they worry they may never see a final resolution to the case.

No one is reading it but you. Who do you think you're providing information to?

People like you and Boutons are strange. You regurgitate confirmation bias articles like a bot like you're campaigning

You both rarely engage in any real conversation. I cannot count the number of times you offered up fake news and then been called on it and you just keep dumping articles like it never happened.
Two conservative SCOTUS justices commented about it

A military commission judge just bollixed the prosecution of KSM because the USA tortured him

But yeah, it's just me who cares

short of torture, extraordinary rendition, black site interrogations and other irregular conditions of detention have had the effect of denying justice to 9/11 victims by tainting confessions

In a new setback to prosecutors in the Sept. 11 case, a military judge on Friday excluded the confessions of another prisoner accused of helping the hijackers who carried out the attacks.

The 51-page ruling was not immediately released. But lawyers who read it said Lt. Col. Michael Schrama, the judge, suppressed the interrogations of Mustafa al-Hawsawi at Guantánamo Bay in 2007.

In the instance of Mr. Hawsawi, the judge said it was not necessary to decide whether he was tortured, only whether he voluntarily admitted his role in the plot when he was questioned by federal agents in a former C.I.A. prison compound at Guantánamo in January 2007.

“A detainee who is shackled, transported to a former C.I.A. black site, and intentionally kept ignorant of both his right to remain silent and the inadmissibility of his prior coerced confessions, cannot be said to be making an ‘essentially free and unconstrained choice,’” he wrote.

Lawyers who read the ruling said the judge emphasized that agents who questioned Mr. Hawsawi at Guantánamo explicitly omitted a reading of a classic Miranda warning of his right to remain silent over four days in January 2007. Nor was he told that his previous statements to the C.I.A. could not be used against him.
He had been held by the United States since March 2003 but was not allowed to see a lawyer. The agents who interrogated him in 2007 “specifically excluded an advisement of the right to counsel,” the judge wrote, according to an extract obtained by The New York Times.

Prosecutors have long considered the admissions made in the 2007 interrogations to be their best evidence against the men who are accused of conspiring in the attacks.

Other evidence prosecutors plan to use at the trial includes statements from other prisoners, transcripts of overseas phone calls and do ents involving wire transfers.

Prosecutors told relatives of the victims of the Sept. 11 attacks last month that they decided not to appeal the ruling in the instance of Mr. Mohammed in order to preserve a June 2028 trial date in the case.

Mr. Hawsawi has often appeared as the most sickly of the defendants, and he has typically volunteered to waive court appearances and remain in his solitary cell at the wartime prison.

For years, he has sat in court on a special pillow or in a padded rehabilitation chair. His lawyers have said he was sodomized while in C.I.A. custody.

Investigations of the secret “black site” program found that Mr. Hawsawi was subjected to a rough, damaging rectal cavity search and also was subjected to a quasi-medical procedure called rectal rehydration.

An additional factor contributed to the judge’s decision: The C.I.A. previously held Mr. Hawsawi at Guantánamo from 2003 to early 2004 in a black-site prison that was then used for his F.B.I. interviews.

In 2007 he told the federal agents questioning him that he recognized the cell they were sitting in from his previous stay.
