The confederate states had their own cons ution. The term "We the People" came about after 1776. Once you leave and form your own government, you're not part of this specific "We the People". They had their own "We the People of the confederate states" which differentiates them from the prior "We the People" with whom they once belonged.

Prior agreements did not contain the phrase "We the People".
Granted, the states never actually left, but they tried to. So given the choice between two armies (as I was), the union army was comprised of folks who did not intentionally separate themselves from the rest.
