    A Judge Just Gave Trump And Arpaio Bad News About Pardon

    This morning, Bolton ordered that the Department of Justice file a memo and scheduled a hearing for October 4th where the Trump team must publicly argue

    why a man who was so racist he was convicted of criminal contempt of court for refusing to end his discriminatory racial profiling policies deserves to walk free.


    The state of Arizona will have their own chance to argue why Arpaio should not be pardoned,

    allowing them to publicly, and in great detail,

    list the full extent of the heinous crimes and misdeeds of Sheriff Joe Arpaio,

    which include running what he refers to as a concentration camp,

    torturing his inmates,

    forcing a woman to give birth in shackles, and

    refusing to investigate sex crimes against Latina children.

    There are OPINIONS for and against whether the pardon of a civil crime against Federal courts is KINGLY pardonable.

    Former Obama Officials Just Took Decisive Legal Action Against Trump’s Arpaio Pardon

    Protect Democracy, a nonpartisan organization founded by former Obama administration attorneys, has charged that Trump’s pardon of former Maricopa County sheriff Joe Arpaio is uncons utional. As such, the advocacy group has insisted that U.S. District Judge Susan Bolton refuse Arpaio’s request to vacate his conviction.

    Protect Democracy claims in an amicus brief that

    Trump’s pardon is not legal in that Arpaio was not simply convicted of a crime, but of violating the Cons ution.

    As such, were Trump to pardon someone guilty of violating the Cons ution, he would be violating his own presidential obligation to uphold the Cons ution.

    “The Arpaio Pardon does not faithfully execute the law; it sends a signal that public officials,

    Jeff Sessions’ Department of Justice had encouraged the court to dismiss the case, claiming,

    If it goes to SCOTUS, it will be a 5-4 loser most probably, but maybe a 4-5 winner with Kennedy.

    Trump administration won’t help Joe Arpaio get his conviction erased

    The
    Trump Justice Department has declined Joe Arpaio’s request for it to ask the Supreme Court to block an investigation into him

    Politico reported Wednesday that Arpaio wanted the DOJ to intervene by asking the Supreme Court to block a special counsel investigation into his contempt of court conviction.

    Though the former Maricopa County sheriff was pardoned by President Donald Trump while he was awaiting sentencing for the contempt of court conviction over his department’s profiling of Latinos,

    Arpaio wants to essentially erase the charge entirely.

    “The pardon appears to have wiped out any chance the 86-year-old will go to prison or face a fine in connection with the contempt charge,”

    U.S. District Court Judge Susan Bolton, however, denied Arpaio’s request — and the DOJ, in turn, declined to “defend Bolton’s decision” when the ex-sheriff appealed it.

    The Supreme Court ruled in United States v. Wilson (1833) that a pardon could be rejected by the convict. In Bur v. United States (1915), the court specifically said: "Cir stances may be made to bring innocence under the penalties of the law. If so brought, escape by confession of guilt implied in the acceptance of a pardon may be rejected, preferring to be the victim of the law rather than its acknowledged transgressor, preferring death even to such certain infamy."
