Marco Rubio was jamming to “Patria y Vida,” the Grammy-winning protest anthem that became a rallying cry for dissidents in Cuba. The hip-hop song, whose le translates to “Homeland and Life,” directly rebuked Fidel Castro’s revolutionary slogan, “Patria o Muerte” — “Homeland or Death.” That was a cause that resonated with Rubio, the son of Cuban exiles, so much that in 2023, he introduced the “Patria y Vida Act,” “protecting against Tyrants” and expanding internet service in Cuba.

    Now, one of the song’s central voices, Cuban rapper Eliéxer Márquez Duany — better known as El Funky — faces removal from the United States. Earlier this month, U.S. immigration authorities denied Márquez Duany’s residency application under the 1966 Cuban Adjustment Act. He has less than 30 days to leave the U.S. or face deportation and likely imprisonment in Cuba, since his music helped fuel the largest anti-government protests in Cuba in decades.

    targeting immigrants for speech keeps getting slapped down in court

    Right before lunch, plainclothes agents from U.S. Immigration and Customs Enforcement (ICE) pulled up in unmarked cars and took 20-year-old international student Mohammed Hoque into custody. The agents had followed Hoque, a management information systems major from Bangladesh, as he was returning from a coding class. He was arrested in front of his parents, who were in town visiting, the day before the family was to celebrate Eid al-Fitr, which marks the end of the month-long dawn-to-dusk fasting of Ramadan.

    On April 9, responding to a lawsuit filed by Hoque that argued he was unlawfully jailed because of his advocacy on social media for Palestinian rights, an immigration judge ordered him released on a $7,500 bond, determining that Hoque did not pose a flight risk. But an immediate appeal filed by Department of Homeland Security ensured that he remained detained and his F-1 visa revoked.

    On May 6, after more than a month in detention, a U.S. district court ordered Hoque’s immediate release, saying there was sufficient and clear evidence of “viewpoint-based targeting” over Hoque’s social media posts and that he was not a danger to the public.

    In an order on Wednesday, U.S. Judge Katherine Menendez was not convinced of DHS’s rationale for revoking Harsono’s visa, noting that he had most recently reentered the country in 2024 and the agency would have been aware of his prior criminal conviction.

    “Moreover, based on the record here, the Court finds it is more reasonable to infer that Respondents have detained Mr. H in retaliation for his speech than because of any professed public safety concern,” Menendez wrote, adding that his detention amounts to “viewpoint discrimination” in violation of the First Amendment.

    The Los Angeles Times on Tuesday shared the story of the family, which came to the United States on humanitarian grounds in 2023: the young girl, identified by her initials, S.G.V.; her mom, 28-year-old Deysi Vargas, who is also Mexican; and her 34-year-old dad, who is from Colombia.


    They have been living in Bakersfield, and S.G.V. has been receiving care for her short bowel syndrome at the Children’s Hospital Los Angeles (CHLA). However, the family received a letter last month stating that their legal status had been terminated and urging them to leave the United States of their own accord, to avoid deportation.



    While spokespeople for U.S. Citizenship and Immigration Services as well as CHLA declined to comment, the Times reported on a letter written by Dr. John Arsenault at the family’s request:


    If there is an interruption in her daily nutrition system, called Total Parenteral Nutrition (TPN), the doctor wrote, “this could be fatal within a matter of days.”
    “As such, patients on home TPN are not allowed to leave the country because the infrastructure to provide TPN or provide immediate intervention if there is a problem with IV access depends on our program’s utilization of U.S.-based healthcare resources and does not transfer across borders,” Arsenault wrote.

    Noam fell for a hoax letter threatening Trump, but not before publicizing it to the world


    Law enforcement believes the man, Ramon Morales Reyes, 54, never wrote the letter, which was sent to an Immigration and Customs Enforcement office and other law enforcement agencies, several sources familiar with the matter told CNN.


    Instead, investigators suspect the letter was intended to benefit a separate individual who is currently awaiting trial in a robbery and assault case in which Reyes is a victim. They do not consider the threat to be credible.


    In investigating the case, agents believe the person may have been involved in sending these letters, claiming to be from Reyes, in an attempt to have Reyes deported before the case could go to trial, sources said.

It said that its assessment of the deportees was based on a thorough vetting process that included looking at crimes committed both inside and outside the United States. But the government’s own data, which was obtained by ProPublica, The Texas Tribune and a team of journalists from Venezuela, showed that officials knew that only 32 of the deportees had been convicted of U.S. crimes and that most were nonviolent offenses, such as retail theft or traffic violations.

    The data indicates that the government knew that only six of the immigrants were convicted of violent crimes: four for assault, one for kidnapping and one for a weapons offense. And it shows that officials were aware that more than half, or 130, of the deportees were not labeled as having any criminal convictions or pending charges; they were labeled as only having violated immigration laws.
