    Gorsuch was not a painful change for the left. He was replacing Scalia, and so that kept status quo. But Kavanaugh is another matter to them because he is replacing Kennedy, the swing vote of the group. Not only is there more urgency to stop him, but there is more urgency to de-legitimize him if he gets on the bench. Moreover, their base demands that they get in the mud and do whatever is necessary to stop this nomination from happening. If the Dems don't, they will hear it from their base.

    That's why the Dems are scouring Yale and asking for people to come forward. That's also why they are helping people remember important facts that they forgot, like that Kavanaugh did it and not someone else.

The Gorsuch nomination was the one stolen from the Democrats that would have given them a 5-4 advantage in the Supreme Court if McConnell and the GOP didn't all of a sudden pretend the president didn't have any authority to nominate people to the Supreme Court. A Kavanaugh nomination just moves the Supreme Court from pretty hard right to very hard right.

    Gorsuch was replacing Merrick Garland, really. If we're talking about Democrats inventing a narrative out of thin air, there's no reason to believe they wouldn't have targeted Gorsuch as retaliation. Yet several Democrats voted to confirm him.
    They also took heat for not fighting more. But the balance of the court didn't shift when Gorsuch was confirmed.

    Also, if for some reason Kavanaugh is not confirmed and Dems retake the Senate, don't think for a second that the Dems will confirm any Trump nomination until after the 2020 election. They will stall for two years (unless he nominates Garland).

    I think they'll go along with a candidate similar to Garland even if it's not Garland. They'll approve a moderate. Trump may have to find a nominee somewhere outside of the Heritage/Federalist Society litmus. That's not a bad thing.

    Honestly the whole President-nominates-Senate-approves process needs to be re-examined.
    I hope not. Republicans can't just decide to have a functioning government only when their guy has the presidency.

    Both sides have used the filibuster. It's pretty stupid to think that only one party used it. Using the filibuster means you have to compromise. But Harry Reid didn't want to compromise, so he got rid of the filibuster, despite being warned of the consequences.

    Don't forget that the Me Too movement started with party toting Democrats (Weinstein et al). Those are the rapists. The ones that were funding Hillary's presidential campaign.

    But there was no rule for the timing of the confirmation of Garland. So Mitch didn’t break a rule, he just didn’t follow the norm. Harry Reid changed an actual rule. Point is you are ok with it, if done by Dems. Your stance isn’t on principle, it’s on party.

    You think you aren’t biased. But bc I disagree with the smears I’m somehow defending the Republican Party on everything? I don’t even post in the other political threads. I only post on this one bc it’s interesting to me from a legal perspective. Every once in a while I get tired of the blind partisanship here and I throw a few punches just to show some hypocrisy that I see in the posts.
