Dutch Court Rules for Apple, Bans Samsung Smartphones, Tablets

A Dutch court has ruled to ban the import and sale of certain Samsung devices on the grounds that they infringe upon Apple's intellectual property.

A judge of the court in The Hague, Netherlands, ruled on Wednesday that Samsung's "tablet PCs with its Galaxy and Galaxy Tab Tab 10.1 and 10.1v and its smartphones Galaxy S, S II and Ace," (quote via Google translation) had violated three specific Apple patents -- a "method of scrolling / browsing gallery", a specific 'unlocking via image' method, and "recording a 'flag' in connection with multiple screen taps".
Of the latter, the order specifically notes that Android OS version 2.3 ("Gingerbread") is at issue, which could imply that any Android device imported and sold in The Netherlands could also be in jeopardy from future Apple litigation. The court specifically excluded this patent from applying to the Galaxy tablets listed.

A minor detail that many sources have seized upon is a film clip from Kubrick's iconic 1968 film "2001: A Space Odyssey" filed as evidence by Samsung. Characters in the film use a device that resembles the iPad in various ways, and Samsung may have intended this to be legal evidence of "prior art" -- but more likely, Samsung may be making the point that devices with similar uses will share a certain amount of necessarily similar design features.
This ban is particularly significant due to the Netherlands' position as a point of import for Samsung's European distribution network. While this has led some sources to report the ruling as a 'Europe-wide ban', Florian Mueller of FOSSPatents has observed that the Dutch court's ruling "does not bind Samsung's Korean parent company -- only three different Samsung subsidiaries registered in the Netherlands -- with respect to other countries than the Netherlands."
"If Samsung's Korean parent company wants to exercise its freedom to ship into other European countries despite this injunction, it will have to reorganize its logistics chain in Europe accordingly,' Mueller writes.
The Netherlands was the sole European exception earlier in the month when a German court also declared a preliminary ban on Samsung's Galaxy Tab 10.1 sales and imports. One week later, the ban was judged to be unenforceable for the remainder of Europe when the Dusseldorf court amended its ruling, having determined that its jurisdiction applied only within German borders.

I'm not really a apple fan but all the bad comments on Jobs is pretty bad as his health made him step down.

They're on the verge of being the most valuable company on earth. They'll be fine. Short term stock hit. Perhaps a small prestige hit.
Ultimately Apple is driven by the products they release and at this point they could release a pile of with an audio jack and it would sell a few million units.
They say the new guy or speculated new guy isn't a Products kinda guy. I'd hate for another American company to bite the dust. Especially now.
Although that's probably a bad thing. If they don't continue to release shiny objects that people think make them look cool then they could be in trouble.

This time is a little different though. Last time they kicked him out after a power struggle. Now he's supposed to stick around on a lesser role. Still a big hit for the company.
tbh, you can rag all you want about Apple, but what made Jobs special was that he was anal retentive when it came to quality of the products the company would put out. Which is exactly what differentiated him from CEOs that just want to hoard money (see Ballmer, Fiorina) without looking what they're putting out.
I'm not ragging on Apple. They make great products. It's the people that buy them for no other reason but to have them as a status symbol. Do what you want with your money... but geez to see a guy buy an Ipad 2 who has no other use for it than angry birds is just annoying.
tbh I'd probably have purchased apple stock a few months ago if it wasn't so expensive per share. they've pretty much annihilated all estimates for like 12 quarters in a row... if not more. I'd rather play with smaller priced stocks that let me buy more shares for the flexibility of easing in and out of buys/sells.
Jobs' emphasis on making Apple products aesthetically pleasing is what has led to such a loyal customer base owning apple products as a status symbol as you just described. It's not like Apple lucked into being a company that was considered to have high end, flashy products. That was because of jobs.
One thing also about Jobs is that he knew how to adjust to the market. Apple released the iPhone in 2008 and now the iPhone is the backbone of Apple's sales every year. If Apple needs to develop another product whenever the next major shift in the electronics market occurs, will the new CEO be as great as Jobs was at predicting what that product needed to be?
