    At this early stage of the proceedings, the Court must determine whether the President followed the congressionally mandated procedure for his actions. He did not. His actions were illegal—both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Cons ution. He must therefore return control of the California National Guard to the Governor of the State of California forthwith.

    About 50 inmates at Delaney Hall, the ICE detention facility in Newark, banded together and pushed down the wall of a dormitory room when meals were hours late, a lawyer told NJ Advance Media.

    Mustafa Cetin, an immigration lawyer who represents a detainee inside the private, contracted jail on Doremus Avenue, said his client told him that simmering dissatisfaction over the quality and timeliness of meals in the facility boiled over late Thursday afternoon.

    “It’s about the food, and some of the detainees were getting aggressive and it turned violent,” Cetin said. “Based on what he told me it was an outer wall, not very strong, and they were able to push it down.”

    Cetin said his client described the inmates being in an a third-floor dormitory and also had bed sheets hung in an apparent escape attempt. His client also smelled gas.

    When Dias Goncalves, he said, showed the officer in Fruita her driver license, the officer said it looked fake and started asking her where she was from. Dias Goncalves said she lived in Utah. The officer, her relative said, questioned if that was the case because he thought she had an accent. Her relative and friends told The Tribune that she doesn’t have an accent, though. One friend was on the phone with Dias Goncalves when she was pulled over.


    Dias Goncalves then told the officer she was born in Brazil and came to Utah as a kid with her parents. Her relative said that was in 2012, when Dias Goncalves was 7.


    The officer told her he would let her go with a warning. The spokesperson for the town of Fruita told The Tribune it was not one of its officers, but likely a state or county agency that first pulled over Dias Goncalves.


    Shortly after, a few miles down the road in Grand Junction, she was pulled over again, this time by immigration officers who arrested her, her relative said.


    “We’re going to take you,” Dias Goncalves said they told her, according to her relative. They didn’t cite a reason.

    "They took me from there, they loaded me up, and they took me to the cemetery that is all the way up Boylston Street," Reyes said in Spanish.

    There, he said he was attacked by officers who shouted obscenities at him.

    "When we got to the top of the cemetery, we stopped there and they took off their vests because that's where they have the camera," he said. "Then they pulled me out of the car and kicked me."

    Reyes says that after repeatedly asking them to check his wallet, one of the officers finally did so. They realized he did, in fact, have his green card, but questioned whether it was real.

    "'I don't know, maybe it's fake' … The other guy says, 'No, it's real' … That's when they finally stopped," he said. "They were planning to keep hitting me because they didn't have good intentions. They took me to a cemetery."

    Even so, the threats continued.

    "Do you think you're a big shot just because you have a green card? I'll make sure they revoke that green card of yours," Reyes said, recalling what agents told him. "'I'm going to do everything I can to get this paper revoked,' an immigration officer told me."\
    "They broke my nose," he said. "One of them hit me. It still hurts here, and that's where the blood came out."

    After the incident at the cemetery, he said he was taken to a cold cell in Burlington. He saw an immigration judge, who dismissed the assault charges federal agents brought against him.

    Reyes said the judge ordered his immediate release.

    A young Baton Rouge family is anxiously waiting for what's next after ICE agents arrested a mother of two in New Orleans last month.


    Paola Clouatre had an appointment on May 27 at New Orleans USCIS for an interview pertaining to her permanent residence status. The 25-year-old entered the U.S. from Mexico and was legally processed with her family about a decade ago. Following the interview, Paola and her husband were told to wait for additional paperwork but instead were greeted by three ICE agents. She's now being held at Richwood Correctional Facility in Monroe.


    Ever since, her husband Adrian Clouatre has been living a nightmare not knowing what could happen next.


    "She had an ICE agent tell her on Friday that she was going to be deported this past weekend," said Adrian Clouatre.


    The Clouatres met in Palm Springs, where Adrian was serving in the Marine Corps. He served five years there before moving back home to Louisiana.


    The Clouatres have two children, a 19-month-old boy and a nine-week-old girl who is still nursing. Adrian Clouatre has been driving the children to see their mom, which is three and a half hours each way, so they can visit and the baby can nurse.

    In interviews, immigration lawyers and family members of those detained describe cramped holding cells with no privacy and modest food rations. Women, in particular, have endured multi-day, difficult stays — in part, lawyers suggest, because there are no ICE detention centers in the state designated for women.


    In one case, a woman detained in Burlington had her period and was denied access to menstrual products like tampons or sanitary pads. When she bled through her clothing, a guard allegedly gave her an extra bottle of water and told her to use it to wash up, according to the woman's sister, Lesly Funez.
    Massachusetts U.S. Reps. Jake Au loss and Seth Moulton, who traveled to the Burlington office on the day of Gomes Da Silva's release to meet him and tour the facility, characterized living conditions there as worse than they’d experienced in the Marines.
    "To be clear, this is supposed to be a processing facility where people stay for six to 12 hours," Moulton told reporters, adding that "it's obviously completely inappropriate — I would say, inhumane — for long-term detention."

    in this case with an assist from local officials running a pretextual sobriety checkpoint

    For Chelsea White and her children, the world as they knew it came crashing down when she and her husband encountered a Tennessee Highway Patrol checkpoint on a Friday night along a quiet stretch of highway in a rural area north of Nashville.
    Around 8:30 p.m. on May 9, White and Hilario Martinez-Garcia were heading back to their home in Ashland City, Tenn., after finishing a cleaning job. That’s when they encountered the THP sobriety checkpoint just north of Springfield.



    During that checkpoint, state troopers were also working with agents from Immigration and Customs Enforcement (ICE), looking for undo ented immigrants. That area in Robertson County they were posted at is primarily a farming community that has been known to attract migrant labor.


    In hindsight, White said she does not believe that officers were really concerned on that night about looking for DUI offenders.
    “What they was looking for,” she told NewsChannel 5 Investigates, “was color of skin.”


    It would be the last time that White would see her 46-year-old husband, who had crossed the border from Mexico a quarter of a century ago and settled down. Married in 2013, the couple have three children, with a fourth child due in November.


    That night, thanks to ICE and the THP, their family was torn apart.


    Martinez-Garcia has since been deported back to a country he has not seen in 25 years, leaving his family without their primary means of financial and emotional support.


    "I never imagined him being gone,” White said as tears streamed down her face.


    “I figured we was good. I figured they was looking for criminals – like Trump said. I figured that they would run his name, see that he's not a criminal and that was it. I didn't think that he was ever going to be taken by ICE."
