well, the staging of a fake hate crime and making false statements to the FBI aren't identical offenses with identical ramifications. equivocating them is a fools errand.
i've already said i think smollette should be tried if the state believes they have a case. i also disagreed with their outright dropping of the charges (unless they have determined they cant prove up the case beyond a reasonable doubt)
Flynn's decorated history was discussed by mueller's team in the sentencing brief. it's a relevant factor. prosecutorial discretion is also a reality. they will consider the magnitude of the harm and the suspect's background in making those calls. it might not be a reality you like, but its there
