"The Supreme Court appeared closely split during oral arguments Wednesday in a case with potentially major implications for the school choice movement, as the justices -- including Chief Justice John Roberts, who presided over President Trump's impeachment trial the previous night until 2 a.m. -- sparred with the lawyers and each other.

The case, Montana Department of Revenue v. Espinoza, centers around a tax-credit scholarship program passed in May 2015 that gave Montanans up to a $150 credit for donating to private scholarship organizations, helping students pay for their choice of private schools. The state's revenue department made a rule banning those tax-credit scholarships from going to religious schools before the state's supreme court later struck down the entire law......."

the supreme court has already held that these types of vouchers are cons utional even if they go overwhelmingly the religious schools, because they've said the parents who make the choice act as a buffer between the state and the religion.

i doubt that underlying basis is going to be overturned.

but that doesnt mean that a state HAS to allow a voucher program. this case is basically trying to force montana to have a voucher program...

With 5 Catholics, 3 Jews on the Supreme Court it'll be real interesting to see how this one goes.

I still can't imagine they'd find enough to force states' hands on this.

the problem is that they apparently cancelled the program because the state supreme court determined that money going to the religious schools violated the law, and as a result they just shut down the entire program.

so if they were wrong in their decision making, it could be seen as discriminatory intent

    Well sure.

And then as you alluded to, the big issue will be the precedent set that if a state has such a program that they'll have to include private schools.

    Sure.

But If he is a Down’s kid, better have the services to teach life skills.
If he is raised with a speech pathology problem, better have the staff to work with him.
    Public schools do.

    it's perfectly dishonest framing.

Who wants to be slandered as against "choice", which in this case is hiding evangelicals relentlessly pushing hard to destroy the Separation clause so taxpayers finance religious indoctrination in (often for-profit) Christian madrasas.

At least in Texas, schools are financed by property tax. That tax is paid either directly or indirectly by the parents. Why shouldn't the parents get a choice on where their education dollars are spent?
