Man Accused Of Taking Lewd Photos Of Girlfriend's Mom

BEXAR COUNTY, Texas -- A San Antonio man accused of taking improper photographs of his girlfriend's 47-year-old mother is behind bars Tuesday, but the suspect's family believes he was set up.
James Aldrich, 23, is charged with improper photography and visual recording.
Aldrich's 19-year-old girlfriend, Desiree Martinez, contacted the San Antonio Police Department saying she found lewd photos on her computer on an e-mail account she created for her boyfriend.
"She said she saw some pictures of a naked woman on the e-mail account," said Sgt. Gabe Trevino, of the San Antonio Police Department. "It was pictures of her mother."
Police said the victim claims the photos were taken with Aldrich's cell phone from her bathroom window at the Martinez home in north Bexar County.
Martinez claims she found the photos around Dec. 22, but did not give a statement until Jan. 4.
Aldrich's family said Martinez was not acting upset when she spent Christmas day with them.
"I believe it's a bunch of nonsense," said Aldrich's sister, Catherine Hernandez. "My brother is not really a pervert type and I don't know why. I know she probably called the cops to get this whole thing, to get this whole thing as a setup."
Martinez said at first Aldrich denied taking the photos, but then she said he told her on Christmas that he videotaped and took pictures of her mother out of curiosity.
Police said they had enough probable cause for an arrest.
"The DA's gonna have to look at the case and look at the cir stances and then they decide about the prosecuting part and going beyond a reasonable doubt," said Trevino.
Aldrich is in the Bexar County Jail on a $10,000 bond.
