If the Clintons would be targeted, they’ll be on the list. Notice the EO gives permission merely to forfeit property/assets at the Treasury discretion, not engage in any kind of judicial role (which the executive can’t do anyways, basic separation of powers).

This EO is more akin to the ones used against drug dealers, etc to freeze their assets whenever they use the American banking system. It’s actually debatable the order is cons utionally sound, but I guess we’ll find out soon enough.
