To answer this question further Castor said he would not prosecute Cosby and by making that gurantee Cosby could not plead the 5th, so the accuser could get justice in a civil suit. Cosby's lawyers did bring it up at trial but apparently the DA didn't file immunity correctly so someone ruled the agreement didn't count so then his deposition in the civilian court could be used as evidence. Which is once again bull because the DA basically said "we can go back on our agreements if we up" incentivizing DAs to up. The Penn SC ruled that the public statement was more than enough to disqualify the deposition but something tells me it had to do with them not wanting to incentivize DA misconduct.

Not in 2005 from what i have seen, this current Cosby case was after metoo but then the new DA used that depo rather than just making a new one.

Maybe it's the wrong word, but what I mean is that he wasn't released because new evidence came out that proved his actions were not illegal, but basically because prosecutors ed up.

she knew exactly what she was doing, it was straight up prosecutorial misconduct with some really questionable rulings by the judge. If this kind of action wasn't overturned, it would have made plea bargains impossible to enforce for the defendants side.
