    Republicans Take First Steps To Kill Five Obama-Era Regulations

    House Republicans on Monday began the process of killing five Obama-era rules on corruption, the environment, labor, and guns under the first real test of the Congressional Review Act,

    Earlier this month it passed bills to limit regulatory agencies and Republican President Donald Trump is cutting regulation through executive orders.

    Under the law, Congress can use simple majority votes to stop recent regulations in their tracks. Timing in the law means any rules enacted after May 31 are eligible for axing.

    The House Rules Committee was expected on Monday evening to send to the full chamber a measure axing three regulations enacted under former President Barack Obama, a Democrat. They were the Stream Protection Rule, the Securities and Exchange Commission’s “resource extraction rule,” and the Social Security Administration’s expanded background checks on disabled gun buyers.

    On Tuesday it will send another measure overturning rules on methane and federal contractors.

    The Interior Department took years to craft the stream rule, hoping to prevent coal-mining waste from contaminating water sources in areas near mountain-top removal mining sites.

    , signed an executive order intended to cut federal regulation. Many news outlets reported that it fulfilled his campaign promise to, on his first day in office, immediately pursue “a requirement that for every new federal regulation, two existing regulations must be eliminated.”

    Yet the Executive Order does not reflect the pursuit of his actual promise. It does not actually require that two regulations actually be repealed, only that agency heads identify “at least two prior regulations” for elimination.

    Federally Recognized Tribes Should Brace For Possible Termination Policy Under Trump

    Federally recognized Alaska Native and American Indian tribes should brace for the worst, including the possibility that Congress may move to terminate federally recognized tribes.

    The termination era of 1953 to 1968 involved Congress stripping tribes of their lands and criminal jurisdiction. The policy was thinly disguised as an attempt to lift American Indians and Alaska Natives out of poverty by assimilating them into mainstream society. However the real goal was to privatize and ransack American Indian and Alaska Native lands.

    From the American Indian Relief Council:

    From 1953-1964 109 tribes were terminated and federal responsibility and jurisdiction was turned over to state governments.

    Approximately 2,500,000 acres of trust land was removed from protected status and 12,000 Native Americans lost tribal affiliation.

    The lands were sold to non-Indians the tribes lost official recognition by the U.S. government….

    Public Law 280 which was passed in 1953 turned power over to state governments to enforce most of the regular criminal laws on reservations as they were doing in other parts of the state.


    American Indian reservations are federally owned lands held “in trust” for tribes. The “vast untapped domestic energy reserves” referred to in Saglutupiaġataq’s energy plan are largely within American Indian reservations. These lands would need to be sold or leased to private sector corporations by the federal government in order for development to proceed. But first, tribal jurisdiction over those lands would need to be terminated by Congress and vested in states.


    The termination era of 1953 to 1968 shows us that tribal lands and thus tribal governments, peoples, and cultures remain vulnerable to the whims of Congress.

    The Republican-controlled Congress on Thursday scrapped Obama-era rules on the environment and guns, counting on a new ally in the White House, President Donald Trump, to reverse years of regulation.

    In the House, the issue was an Obama rule extending background checks for disabled Social Security recipients mentally incapable of managing their own affairs. The vote was 235-180.

    Under the rule, the Social Security Administration would provide information to the gun-buying background check system on recipients with a mental disorder so severe they cannot work and need someone to handle their benefits. The rule, finalized in December, affects an estimated 75,000 beneficiaries.

    Last week, Minnesota’s House Committee voted to punish protestors by making protestors have to pay the law enforcement costs of covering a protest.

    While all but one speaker decried the bill as an attempt to intimidate protesters and curb First Amendment rights, in the end the bill passed out of the committee with a 9-6 split along party lines — with every Republican on the committee voting for it, and every Democrat against.

    The bill’s 27 authors, all Republicans including House Speaker Kurt Daudt, also include eight members of the committee to which it was referred: the House public safety committee, chaired by Rep. Tony Cornish, R-Vernon Center, who is also listed as an author.

    Even though there are just a handful of cases in which a religious group’s political advocacy has been challenged by the IRS, Americans widely support the law. LifeWay, a religious research organization, found that 79 percent of U.S. citizens don’t believe “pastors [should] publicly endorse political candidates during a church service.”

    Under the law, religious groups are allowed to discuss political issues, if not actually endorse candidates. They are also permitted to participate in politics and keep their nonprofit status, which exempts them from paying federal taxes. Current IRS guidelines stipulate that churches are allowed to spend no more than 20 percent of their operating budget on political organizing and advocacy.

    Lifting those guidelines would erode the separation of church and state as we know it, allowing churches to effectively operate as America’s most powerful Super PACs.
