    The School Shootings That Weren't


    How many times per year does a gun go off in an American school?

    We should know. But we don't.


    This spring the U.S. Education Department reported that in the 2015-2016 school year, "nearly 240 schools ... reported at least 1 incident involving a school-related shooting." The number is far higher than most other estimates.


    But NPR reached out to every one of those schools repeatedly over the course of three months and found that more than two-thirds of these reported incidents never happened.

    Child Trends, a nonpartisan nonprofit research organization, assisted NPR in analyzing data from the government's Civil Rights Data Collection.


    We were able to confirm just 11 reported incidents, either directly with schools or through media reports.


    In 161 cases, schools or districts attested that no incident took place or couldn't confirm one.

    In at least four cases, we found, something did happen, but it didn't meet the government's parameters for a shooting.

    About a quarter of schools didn't respond to our inquiries.


    "When we're talking about such an important and rare event, [this] amount of data error could be very meaningful," says Deborah Temkin, a researcher and program director at Child Trends.

    Secretary of Education Betsy DeVos is preparing new rules that will expand protections for students and staff accused of sexual misconduct, including assault, harassment, and rape, while protecting the schools and colleges they attend.

    “The proposed rules,” The New York Times reports, “narrow the definition of sexual harassment, holding schools accountable only for formal complaints filed through proper authorities and for conduct said to have occurred on their campuses. They would also establish a higher legal standard to determine whether schools improperly addressed complaints.”

    The Education Secretary’s new rules would literally allow an accused rapist to cross examine his or her alleged victim.

    The Obama administration also strongly discouraged parties from personally questioning each other during hearings, believing it would be “traumatic or intimidating, thereby possibly escalating or perpetuating a hostile environment.”

    These new rules would also allow “victims and their accused perpetrators to request evidence from each other,” The Times adds.

    “The rules also allow the complainant and the accused to have access to any evidence obtained during the investigation,

    even if there are no plans to use it to prove the conduct occurred.”

    That could lead to very personal information or belongings – say, text messages, photographs, or underwear –

    being shared with someone accused of sexual misconduct, harassment, or assault.

    A Washington federal court judge ruled Wednesday that the department’s postponement of the so-called Borrower Defense rule was procedurally improper.

    The Obama administration created the rule in the wake of revelations that some for-profit colleges enticed students with promises of an education and diplomas that would enable them to get jobs in their chosen fields.

    In reality, many of those certifications weren’t recognized by prospective employers, leaving graduates saddled with student loans they couldn’t repay.


    The Borrower Defense regulations changed the rules for forgiving student loans

    in cases of school misconduct and required "financially risky ins utions" to be prepared to cover government losses in those instances,

    Since 2009, Nelson — whose nomination was advanced by Republicans on the Senate Judiciary Committee on Thursday — has worked as general counsel for Melaleuca, a health and wellness company owned by VanderSloot.

    During his time with Melaleuca,

    Nelson issued legal threats against reporters and news outlets at the behest of VanderSloot, who sources said uses legal intimidation to mitigate negative press coverage.

    Nelson’s ascension to a top judicial position as “a terrifying threat to reporters and the First Amendment.”

    His job for VanderSloot, they said, was to “threaten and bully journalists trying to cover” the Idaho billionaire.

    The most notable of the Nelson-led lawsuits against the media was VanderSloot’s battle against liberal magazine Mother Jones, which lasted from February 2013 to October 2015.

    Despite the controversy surrounding the case and claims of anti-First Amendment legal action, when responding to a questionnaire from the Senate Judiciary Committee, Nelson
    listed the Vandesloot vs. Mother Jones lawsuit as one of the top ten “most significant” cases that he has handled personally.

    “This nomination certainly seems consistent with the White House’s hostility toward a free, independent, and fearless press,

    “Mr. Nelson is a conservative ideologue who has advanced a right-wing policy and litigation agenda throughout his career,”

    the civil rights group disapproves of Nelson’s work against environmental protection and disabled people’s rights, as well as his lengthy history as a member of the Federalist Society — a conservative legal group that has aided in the Trump administration’s judicial nominations — and his role in the Bush administration.

    the White House will push for cuts to life-saving safety net programs like Medicare and Social Security

    if the GOP retains control of Congress in November.
