Court: Emoluments Clause Applies To Trump And His Hotel Profits
A landmark case arguing that Trump has violated the Cons ution by accepting foreign government money is going forward.
President Donald Trump is subject to the Cons ution’s emoluments clause, and
any profit, gain or advantage that his hotel in Washington, D.C.,
obtains from a foreign or domestic government would implicate the clause,
according to a ruling by a federal court on Wednesday.
This decision, by Judge Peter Messitte for the U.S. District Court for the District of Maryland, allows a lawsuit brought by the attorneys general of Maryland and Washington, D.C., to
proceed against Trump, whose effort to dismiss the challenge was denied.
The lawsuit claims that he is in violation of the Cons ution’s emoluments clause,
which bars federal officeholders from receiving financial or material benefits from foreign governments or domestic government bodies.
“It’s a historic decision,” Maryland Attorney General Brian Frosh told HuffPost.
“The judge says that the emoluments are broad anti-corruption clauses and can be enforced in the courts.”

President Trump on Thursday used a taxpayer-funded trip to Illinois to openly advocate for electing Republicans to Congress — blurring the line between official and political events in the heat of the midterm campaign season.
Trump didn’t name the lawmakers, but
three Illinois Republicans accompanied him during his tour of the plant, according to the White House:
Reps. Mike Bost, Rodney Davis and John Shimkus.
Bost represents the district Trump traveled to on Thursday and has been one of the most fervent Republican supporters of the president’s tariffs on steel and aluminum imports.
White House spokesman Hogan Gidley told reporters on Air Force One that “there is no legal prohibition” on endorsing political candidates at
official, taxpayer-funded events.
