You can't have the trial without the House starting the process and bringing the articles of impeachment, period.
This is where this conversation started: you need control of the House to start any impeachment process.

If you're saying they had impeached already fine. He resigned and was a private citizen. They continued with the impeachment anyways. Precedent set to go along with no prohibition on it in the first place.
