John Roberts Won’t Let Mitch McConnell Derail a Trump Impeachment Trial

McConnell indicated that he is aiming for a rapid process that might start around Thanksgiving and end by Christmas.

There are many reasons, though, to think that such a rush to judgment will fail.

The Cons ution explicitly states that the chief justice, in this case John Roberts, “shall preside” over presidential impeachment trials.

The rules of the Senate, moreover, require McConnell to take this command seriously.

In order to prevent the vice president, who formally presides over the Senate, from refusing to allow the chief justice to play his cons utional role,

the Senate rules governing impeachment require the vice president to swear in the chief justice immediately after the House’s charges are announced on the floor.

The rules then explicitly empower the chief justice to “direct all the forms of proceedings” during the trial.

The Senate, in contrast, is granted the “power to enforce obedience” to all these rulings.

The current rules are not written in stone. The existing Senate could change them before the trial begins.

Because all Democrats would oppose this move, only three Republican defections would stop the majority leader in his tracks. From his public statements, it’s already clear that Sen. Mitt Romney would never go along.

it is implausible to suppose that these three senators would support any rule change that, in Williams’ words, would make the chief justice into a “figurehead” for blatant partisan politics.

    Some commentators have
suggested that McConnell could invoke this provision to require a final Senate vote by a specific date.

Again, it seems almost certain that at least three Republican senators would defect to prevent such a partisan power play.

Given his deep commitment to professionalism, John Roberts can be counted on to deflect any behind-the-scenes pressures for speed.

These inclinations would be reinforced, moreover, by the recent controversy surrounding the appointment of Brett Kavanaugh.

Roberts cannot allow the same hardball tactics to repeat themselves.

Given the heated controversies that will be generated by these decisions,

the chief justice will be even more reluctant to waste his political capital by enabling a partisan rush to judgment on Trump.

Given the length and complexity of the potential charges, the entire process, including preparation time, could last for months.

Bill Clinton’s trial lasted four weeks; Andrew Johnson’s lasted 10.

How long will Donald Trump’s take?

Trump’s attack on congressional legitimacy ‘boggles the mind’: Ex-Whitewater counsel

Alexander Hamilton warned about leaders like Trump in his writings — and the president’s stunning declaration of the impeachment probe as “crap” and “illegitimate.”

Hamilton, who was a defender of executive power,

would have supported impeaching Donald Trump.

He cites one of his Federalist Papers, where Hamilton writes, in part,

‘When a man unprincipled in his private life,

    desperate in his fortune,

    bold in his temper …

when such a man is seen to mount the hobby horse of popularity

to take every opportunity of embarr ing the general government and bringing it under su ion,

it may justly be suspected that

his object is to throw things into confusion that he may ride the storm and direct the whirlwind.’

Hamilton warning such a leader will become a demagogue and a tyrant

Does it sound like Hamilton, even so long ago, could have been warning about a person like President Trump,

he’s warning about is an authoritarian populist who destroys American ins utions as a way of maintaining power and cowing his political opposition,”

    “I can’t imagine

    how anyone could think that

a process that is explicitly provided for as a check against abuse of authority

was, itself, an illegitimate act of Congress,”
    added Rosenzweig.

    “It boggles the mind.”

Torture Cheerleader John Yoo Is Back To Lie About The Cons ution

Yoo, who once argued that the president could m acre entire villages and crush children's testicles

if he wanted to, is back on the scene. But instead of torturing Muslims, this time he's here to torture American history.

Speaking to white nationalist Laura Ingraham (because of ing course she would want to have Yoo on her show),

Yoo once again spewed incoherent nonsense that has no basis in fact.

Though that's probably par for the course for the guy who's claim to fame is defending the use of waterboarding.

Let's take a look at what Yoo had to say.

What the Framers thought was that the American people would judge the President at the time of the election.

    Okay ... no.

What the Framers thought was that

the House of Representatives would impeach and

the Senate would convict if the president committed a bunch of high crimes and misdemeanors.

That's why they put it right there in the Cons ution!

    Yoo keeps going:

They would never have wanted impeachment within a year of an election.

It's up to the American people.

If the American people think Trump has done wrong,

they don't have to return him to office.

If they don't think this was important, they'll reelect him.

    Oh, apparently we're taking

Moscow Mitch's Merrick Garland rule and applying it to impeachment now?

Except, like Moscow Mitch's Merrick Garland rule, it's not actually a thing at all. It's completely made up bull .

There's no "except within one year of an election" exception to Congress's impeachment power.

Because that would be really ing stupid and

would allow presidents to commit all sorts of high crimes and misdemeanors in their last year of office. Kind of like Trump has been doing this whole time.

Morning Joe drops bomb on Trump about impeachment support in states he desperately needs in 2020

“Half of the voters in six states that helped carry Trump to victory in 2016 say they support the House Democrats’ impeachment inquiry into the president.

    According to the latest,
New York Times/Siena College poll put that support at

    50 percent of voters in

    Pennsylvania,
    Florida,
    Michigan,
    Wisconsin,
    North Carolina and
    Arizona —

    45 percent say they oppose.”

“Lynching” is what the GOP would have done to obama the day obama fired comey and bragged about it in the oval office - in that mtg where ONLY Russian media was allowed to attend.

the lynching would have taken place “live on FOX news” from the white house lawn attended by GOP racists taking selfies at the foot of the tree

Is this why he compared his impeachment to a lynching?

    Trump spokesman defends ‘lynching’ remark:

‘Let’s talk about what the president has done for African-Americans’

Hogan Gidley yet another Baghdad Bob staining himself

“The president is working for the American people..."

Fox News host Sandra Smith asked Gidley if the president would consider taking down the tweet since

    African-American lawmakers have expressed outrage.

“This president has done more to lift the lives of all Americans than anybody else. ..."

    ‘Do us a favor’:

4-page Pelosi fact sheet uses Trump’s own words to make case for impeachment

Speaker Nancy Pelosi on Monday released a four-page fact sheet outlining how President Donald Trump “betrayed his oath of office” for personal gain by pressuring Ukraine to investigate former Vice President Joe Biden.

The do ent’s three sections— led

    “The Shakedown,”

    “The Pressure Campaign,” and

    “The Cover Up”

use the words of Trump and members of his administration to build a ulative case that the president has abused his power and should be impeached.

Looks like the Dems are going to ignore the 9? impeachable instances of Trash obstructing investigations.
