the supreme court has already held that these types of vouchers are cons utional even if they go overwhelmingly the religious schools, because they've said the parents who make the choice act as a buffer between the state and the religion.
i doubt that underlying basis is going to be overturned.
but that doesnt mean that a state HAS to allow a voucher program. this case is basically trying to force montana to have a voucher program...

the problem is that they apparently cancelled the program because the state supreme court determined that money going to the religious schools violated the law, and as a result they just shut down the entire program.
so if they were wrong in their decision making, it could be seen as discriminatory intent

And then as you alluded to, the big issue will be the precedent set that if a state has such a program that they'll have to include private schools.

Who wants to be slandered as against "choice", which in this case is hiding evangelicals relentlessly pushing hard to destroy the Separation clause so taxpayers finance religious indoctrination in (often for-profit) Christian madrasas.
At least in Texas, schools are financed by property tax. That tax is paid either directly or indirectly by the parents. Why shouldn't the parents get a choice on where their education dollars are spent?
