    The HOA has nothing to do with the technical ownership of the private street. They might administrate the repairs and make the assessments but the homeowners own the streets.
    dont think it works that way though. can i, as a homeowner, run up and down the street and use the castle doctrine 200 feet away from my house?

    By definition brandishing a weapon means you pointed it at someone. Based on the video both of them actually pointed their weapons...her more than him but they both did it.

    LOL. You don't know that unless you've read that particular HOA's do ents. Which I doubt you did.
    Having read the HOA docas for my own HOA, I know exactly which streets are owned by the HOA and which are owned by the county. The corporation owns some of them, and sets aside money in the budget for their repairs.

    I would imagine it would be the same, especially in a gated community. It would pretty much have to be that way if you are putting up a gate. I don't imagine it could possibly be legal to block off a public road like that.

    nothing there demonstrates that any of the protestors were on their property. looks like they were on the sidewalk at best. in fact its clear they were just walking by it and moving along the whole time, all the while these people are pointing guns at them

    I never said they could use castle doctrine.. I said technically the mob was trespassing. You can't shoot them for just trespassing (which they didn't).

    It's not all the same though. It varies from HOA to HOA and from state to state. It may turn out be the case but for CC to state it as fact without really knowing is presumptuous.

    they gate was busted after the fact. the video footage shows them walking through a gate that was just opened along its hinges. there are photos after the fact showing the gate bent down/bent over... but that doesnt match the video footage which shows them walking in in the first place. not saying that the property damage should go unpunished, should they identify the person(s) who participated

    agree that the case might not be cut and dry (though "lawn" implies their specific property and not just the general street), and agree that it's been politicized all around. i still dont think you can run up and down the street claiming castle doctrine the whole time

    prosecutor pushing towards the "diversion program" shows they just want this to go away without looking like they're folding, imo.

    you already did. look at 7:09 of the video below

    and notice how both the gates (though one is swung open) are still upright, in tact. compare that to the image below, which is clearly after the fact. not excusing the breaking of the gate, but they didnt bust the gate down to get in, clearly

    Isn’t access to a gated community like this restricted to only those that live in the community, those that are invited by the homeowners that live in the community, and workers doing repairs or maintenance on the homes or grounds?

    in an upscale gated community like this, isn't there private security to handle this type of situation?

    In this situation, I would think it would be safer to stay in the house and turn on the security system as opposed to going outside with weapons.
