This isn't a judicial problem, so the SCOTUS should have no say in it. Far from the first time SCOTUS seats have been added/removed by Congress.
Manchin has said he will not vote to pack court or end filibuster. Sinema may not even be on board either. Seems DOA.
I could definitely see term limits for justices, though.
This is something that won't happen until after the 2022 election at which time if dems win 1 or 2 more seats, then Manchin has no say and he can have his no vote.
Elections have consequences!
