    There's no outright ban on abortion. These are just abortion control laws. Like gun control they are about saving the lives of the kids. Cons utional rights have limits.

    The whole reason its set up this way is because by not assigning officials to uphold the law and farming it out to civies there's nobody to sue. This same 6 week limit has been tried before but never stood cons utional scrutinyBy this penalty structure California could ban gun ownership and anyone owning a gun could then be sued. Because a funny thing happened on the right's way of getting around the cons ution, they got around the cons ution.

    while the statute might not grant attorneys fees.... at least in CA there is a specific statute that allows for a party to be sanctioned for filing a frivolous suit, generally, including a payment of attorneys fees

    im not familiar enough with texas codes, but i have to imagine there is some basic framework to prevent purely frivolous suits
    You want to know the real ty thing in most cases Texans can't put attorney's fees as a line item on their claims, for all accidents the attorney gets paid out of the settlement instead of by the perpetrator. But they put attorney's fees in this protecting the snitches but not their own citizens

    i hear you.

    im just saying regardless of the case type in california, and even in a type where attorneys fees are not provided for (say, a personal injury suit), you can always file a motion for sanctions if their pleadings are entirely frivolous, and you can receive attorneys fees if you prevail on that (even though the bar is pretty high to prove that a case is frivolous). or you can file a follow-up suit for malicious prosecution.

    i dont know if texas has any equivalents, though i'd be shocked if they didnt at least have the opportunity to bring a motion for sanctions
