It was pretty much a bull charge. Worst he should get is probation. The judge is not obligated to follow the federal sentencing guidelines.
The tax evasion charge in California is another story. If any of us cheated the IRS out of millions we would be in a fed pen for a long time.

As a Second Amendment hawk I agree. I mean, yeah he should be guilty of perjury for lying when he bought the gun but that's about it and that doesn't typically carry more than fines and probation. But there's also the point that he easily could have gotten guns illegally off the black market and you're penalizing a guy for doing it the right way even if he had to lie a smidge about it.
Income tax is bull but, like you said, if ordinary people do at least a year in prison for that , then he should too. However, I'm curious as to the jurisdiction on that one... why is it in California if it revolves around the IRS? Wouldn't it be his home state or DC? I was assuming he was dodging California state income tax or something.
