in a perfect world i would probably agree with you. in a 2A, open carry world, its not, unless he was brandishing it. dont think from the rapid photos we can demonstrate that he was brandishing it discernibly before bubba maced him

Do you think the guy who did the flying kick on KR should be charged?
You seem to be confused about this. There's absolutely nothing wrong/illegal about pulling a gun after you've been attacked. Nothing. You seem very, very confused about this particular topic.
Shooting the gun afterwards, that's way more debatable.
I’m not confused at all. I already said there was no crime committed when he pulled his gun after being assaulted. The escalation wasn’t the crime. I clearly said using lethal force against non-lethal was the crime.

drawing =/= brandishing. drawing a weapon as somebody was just assaulting you isnt in and of itself unreasonable. neither is discharging it while they are in the process of macing you, imo

Do you think the guy who did the flying kick on KR should be charged?
probably
well yeah, he reached for the sky, stopped, and kyle didnt shoot (which tbh actually showed remarkable restraint given what had just happened). but then the guy obviously didnt just want to stand there in perpetuity with a gun drawn him, so he tried moving away toward the sidewalk at which point rittenhouse panicked and shot him, which you just cant do
Didn’t the last guy to get shot charge him with an illegally possessed handgun drawn? That’s going to be a tough one for the jury.
drawing =/= brandishing. drawing a weapon as somebody was just assaulting you isnt in and of itself unreasonable.lets be honest it was a bitch slap and bitch slapper backed off. It wasn’t illegal to draw but it was fucking stupid and against any sort of training taught in concealed carry classes.

agreed. i dont think drawing a weapon that you are legally allowed to draw is going to be held against him in a self defense claim. the whole "it was stupid but not illegal" narrative is basically what i applied to rittenhouse showing up to riots with a rifle as if he was going to be able to do anything besides stir shit up
mace isn’t a lethal weapon, the escalation to lethal force was a crime.
i dont think a lethal weapon is required to satisfy the reasonable fear of great bodily injury element

of course not. but what's "deserved" is not relevant unless you're in court. people get killed in self defense all the time, even if the assault/burglary being defended from would not bring with it a death penalty through the justice system
a woman would be justified in using lethal force to defend herself from rape even if the rape itself isnt punishable by death
I am not taking a legal side here, you guys are much more knowledgeable in that realm.

IMO because a gun was present, the outcome had a greater chance of becoming deadly.

This self protection stuff by deadly weapon is just ... deadly.
Does anyone run anymore? Just get the hell out and find out whats up later. There are witnesses.

Yeah, you are. You keep saying the guard 'escalated' by pulling his gun. He didn't. He wasn't going to continue to get assaulted having a weapon on him. There's absolutely nothing to the fact that he pulled the gun on this guy that just assaulted him. Completely normal, self-defense action.
You also keep forgetting this guys was a guard working on protecting other people. If he's disabled, he can't do his job, and that puts the people he's protecting in danger.

A lawyer who said he represented Dolloff's family, Doug Richards, said on Monday that Dolloff opened fire because he saw Keltner reach into his pocket and he feared for his safety. The Post photos do not appear to show that. Richards did not return a telephone call and an email seeking further comment Tuesday.
Police have said that two guns were found at the scene. But the affidavit did not address a second gun.
Dolloff has been jailed for investigation of first-degree murder, but he has not been charged.

hasn't been found guilty yet. no different than rittenhouse other than number of people he's been accused of murdering
he'll get his due process. i'm still skeptical he'll be found guilty but content with the system playing itself out

Sure. Based on what I've seen he should be convicted for murder.
This really just an update.

Pretty much. The All-Star Confirmation Bias Brigade's breathless assessment of what is clear to them misses how good attorney's can work "reasonable doubt" in an actual courtroom.

Second-degree murder is usually a Colorado class 2 felony. Penalties can include as much as:
48 years in prison, and
A fine of up to $1,000,000.
Fortunately, there are numerous defenses to murder two charges. These include accidental killing, self-defense, defense of others, police misconduct and diminished capacity / insanity (although diminished responsibility is not a defense if it was due to self-induced intoxication).
In addition, your penalty may be reduced if you acted in a sudden heat of passion, caused by a serious and highly provoking act that would excite an irresistible passion in a reasonable person.
You are aware that your conduct is practically certain to cause the result prohibited by a particular law.
One shot was fired.
More here. Plenty of things to hang specific legal defenses on.

Agree with Chump on this.
Dude has a good shot at "not-guilty". I would not assess it as anything close to a slam dunk either way.
