Texas spent another 22,000 hours hunting for 'election fraud' and didn't find a damn thing

the numbers are about what you'd expect for an indicted ultrapartisan casting lines everywhere in search of justifications for his party's attacks on voting rights.

Paxton's office logged "more than 22,000 staff hours" working on voter fraud cases in the last year,

roughly doubling both the law enforcement officers and prosecutors already assigned
to those cases. All 22,000 hours were paid for by Texas voters.

Sixteen cases. The team closed out 16 cases, all of them for Houston-area residents who

wrote "false addresses" on voter registration forms.

None of the 16 went to jail for it. That's in keeping with his department's long-term record,

which has never found any organized fraud

of the sort Paxton continues to insist exists somewhere, just beyond our visible realms.

Shithole Texas shitbag Governor focuses on denying workers paid sick leave

The Delta variant is ravaging Texas.

But Abbott has not only rescinded all state efforts to slow the spread of COVID but, in July, signed

an executive order (https://gov.texas.gov/uploads/files/press/EO-GA-38_continued_response_to_the_COVID-19_disaster_IMAGE_07-29-2021.pdf) preventing cities and counties from taking action.

The executive order states that no "county, city, school district, [or] public health authority " can "require any person to wear a face covering" or get a COVID-19 vaccine.

(There is an exception that allows jails and hospitals to require masks.)

It also stops local governments from mandating COVID-19 vaccines.

The executive order also prohibits any "COVID-19-related limitations imposed by local governmental entities or officials" on businesses.

But for Abbott, this executive order is not enough. He called a special session (https://gov.texas.gov/uploads/files/press/PROC_second_called_session_87th_legislature_IMAGE_ 08-05-21.pdf) of the legislature that began last Saturday at noon.

In this new session, Abbott has added several new items, including this one:

Legislation shielding private employers and employees from political subdivision rules, regulations, ordinances, and other actions that require any terms of employment that exceed or conflict with federal or state law relating to any form of employment leave, hiring practices, employment benefits, or scheduling practices.

What is this about? According to The Texas Tribune (https://www.texastribune.org/2021/08/02/greg-abbott-texas-special-legislative-session/), the item is

"a longtime priority of the business community that has failed in recent regular sessions:

preempting local labor laws, such as mandatory paid sick leave."

So during a raging pandemic, Abbott has called an "extraordinary session (https://gov.texas.gov/uploads/files/press/PROC_second_called_session_87th_legislature_IMAGE_ 08-05-21.pdf)" to make it harder for people to get paid sick leave.

access to paid sick leave means that fewer people show up to work when they are sick.

Keeping sick people at home is a fundamental way to control the spread of COVID.

Currently, about 40% of Texas workers (https://www.star-telegram.com/latest-news/article241076471.html), which is more than 4 million people, lack paid sick leave.

This includes 75% of service industry employees.

In recent years, Austin, Dallas, and San Antonio have

passed ordinances requiring employers to offer paid sick leave.

These ordinances, however, were blocked by Texas and federal courts,

which found it conflicted with Texas' minimum wage law by requiring compensation in excess of the minimum.

Business lobbyists, however, are still worried and want a state law prohibiting cities localities from passing future ordinances.

Abbott is happy to oblige.

Texas warns Austin restaurants that liquor licenses could be revoked for requiring vaccine proof

Here comes another Texas voter purge, but this time with a wrinkle

Two years after Texas officials fumbled an effort to double-check the voting rolls on a hunt for noncitizens —

and instead threatened the voting rights of nearly 60,000 eligible Texans —

similar efforts to purge noncitizen voters are now the law of the land, thanks to provisions tucked into the massive elections bill enacted this month.

The secretary of state will again be allowed to regularly compare driver’s license records to voter registration lists in a quest to find people who are not eligible.

Starting by December of this year, the secretary of state will review Department of Public Safety records every month looking for potential noncitizens.

But this time, lawmakers have put in a provision that intentionally bars the secretary of state from going too far back in time as they scour driver’s license records,

In some instances, the state flagged legal voters who had become naturalized citizens since the time they first applied for a driver’s license a decade or more earlier.

Noncitizens, including those with visas or green cards to stay in the U.S., are able to get Texas driver’s licenses.

The great unifying sin of Gov. Greg Abbott’s tenure is that, of course, he knows better.

He knows it is blatantly unconstitutional to arrest people and not provide representation or due process for weeks on end.

One doesn’t have to be an attorney to know and understand this,

but for a public official with Abbott’s legal pedigree,

the failure to honor due process is galling.

Conservatives in Texas and several other states have declared war on the teaching of books aimed at sensitizing students to racism and gender identity issues, saying they wrongly inflict feelings of guilt on white and non-LGBTQ students.

Over 70% of beds available to adolescents for residential drug treatment in Texas are designated for males.

Male juveniles in the state have more than double the options for treatment facilities a female the same age can access.

tossing out Texas' silly content moderation law as clearly unconstitutional under the 1st Amendment.

As was widely expected, Texas has appealed the ruling (https://storage.courtlistener.com/recap/gov.uscourts.txwd.1147630/gov.uscourts.txwd.1147630.54.0_1.pdf) to

the 5th Circuit (undeniably, the wackiest of the Circuits, so who knows what may happen).

However, in the meantime, Texas Attorney General Ken Paxton

also asked the lower court to have the law go into effect (https://storage.courtlistener.com/recap/gov.uscourts.txwd.1147630/gov.uscourts.txwd.1147630.53.0.pdf) while waiting for the appeals court to rule!


A stay is also supported by the widely recognized principle that enjoining a state law inflicts irreparable harm on the state, and that the public’s interest is aligned with the state’s interest and harm.

Plaintiffs, in contrast, will not be irreparably harmed if a stay is granted.

This is evidenced by the fact that

(1) their supportive members stated they either already comply with aspects of the law or could not explain how the law would be burdensome in practice; and

(2) Plaintiffs’ other members, filing as amici in opposition to the Preliminary Injunction,

have demonstrated no harm will occur by enforcement of H.B. 20.

For all these reasons, as further set forth below, a temporary stay while the Fifth Circuit considers the merits of this Court’s Preliminary Injunction is warranted.

Correspondingly, the

Attorney General has demonstrated a likelihood of success on the merits regarding Plaintiffs’ claims.

it did so by relying on readily distinguishable First Amendment case law and giving dispositive weight to a novel “fact”:

whether the entity “screen[s] and sometimes moderate[s] or curate[s]” user generated content.

Therefore, given the novel nature of Plaintiffs’ claims and the substantial support for the Attorney General’s arguments,

the Court of Appeals should have an opportunity to consider these issues before the injunction is implemented.

A school district has an affirmative obligation to do a genuine review and not pre-judge the merits of the books by taking them off the shelf.”

The Chapter 313 monster — the mother of all corporate welfare — revives?

proposed rule changes by the Texas comptroller’s office, which they claim will harm transparency and allow the monster — Chapter 313 tax breaks — to rise from the dead (https://www.expressnews.com/business/business_columnists/michael_taylor/article/the-worst-chapter-in-Texas-corporate-welfare-16186770.php).

So what are critics worried about?

The fiendish Chapter 313 is a tad complicated, but let’s review the basics.

A private company (often an energy company, but not always) wants to build a new facility in Texas.

It makes a threat (usually fake, according to a Hearst investigation and academic studies) that it might build the thing in some other state and says

it needs a break on school property taxes to invest in Texas (https://www.expressnews.com/news/article/news/investigations/article/unfair-burden-part-1-texas-tax-corporations-covid-16164744.php).

I say fake because in 85 percent of cases, the companies would have built their operations in Texas without the incentive,

according to a report by University of Texas at Austin professor Nathan Jensen, a longtime critic of the Chapter 313 program (http://cdn.equitablegrowth.org/wp-content/uploads/2017/10/19153356/10242017-WP-exit-options-negotiations.pdf).

So it’s a pure giveaway to encourage a company to do the thing it would have done anyway. And you’re paying for it.

Here’s how you’re paying:

A local school board approves a 10-year property tax break to build the thing in Texas.

For big companies, this can be worth tens of millions of dollars.

A database maintained by the comptroller (https://comptroller.texas.gov/economy/local/ch313/agreement-docs.php)lets you see how much and for how long companies get this incentive.

The Texas comptroller’s office has approved 97.5 percent of these deals. In other words, it has not been a real check on Chapter 313.

Part of the program’s evil genius is that the state wholly reimburses the local school district for its 10 years of forgone tax revenue,

so school districts almost never say no.

And when I say “the state” provides reimbursement, I mean that ultimately you, dear taxpayer,

reimburse the company for building the thing it was already going to build in the first place.
This became such a successful corporate welfare game that by March 2021, there were more than 500 active Chapter 313 agreements and

the cost of the program exceeded $10 billion in state funds.

A comfortable majority of Latinos — an estimated 61 percent — supported President Joe Biden, but there was about an 8 percentage-point swing toward Trump, based on data on votes cast for either the Democratic or Republican nominees in 2016 and 2020.
The data shows that many Latino voters, who represent the fastest-growing share of the electorate, are not firmly part of the Democratic base. Instead, they seem to be persuadable voters, presenting a potential opportunity for both Democrats and Republicans. This is especially true for voters who aren’t hyperpartisan: new and infrequent voters, as well as people who flipped their votes in 2020 or who decided to sit the election out entirely.
