There's no question the State has a right to protect human life (and when a clump of cells become human was always a sticky point), but it can't do so stepping on constitutional rights.

If it's enactment caused damage, then the State will have to respond for that damage.

It matters because the relationship with the host is strictly parasitic during a large part of gestation.

Even if SCOTUS upholds the TX law I expect it to be modified next year after Texas state courts get slammed with new abortion cases and can't function because they're so crowded. The TX courts were already jammed up due to 'Rona.

They will wait until it lands in their docket after being struck down at the lower courts and appealed.

Then they will consider it and strike it down too, because the actual precedence that this law sets is something so abhorrently egregious about government violation of rights that even the hacks that Dump put in place won't be able to let it slide.

United States v State of Texas, on the other hand, is much broader in scope and much more aggressive. Unlike the suit brought by the plaintiffs in WWH v Jackson, U.S. v Texas sues the state of Texas in its entirety.

There is yet another way that U.S. v Texas differs from WWH v Jackson. The federal government’s litigation also sues the state of Texas for violating the due process clause of the 14 Amendment of the United States Constitution, which runs as follows:

Has Texas violated the due process clause with SB 8? Indeed it has, and for the reason the federal government has given.

the due process clause has the effect of prohibiting a state from barring the former slaves (or any U.S. citizen) from securing their equal rights in courts of law, or to make it more difficult for them to do so. (In the law, the latter is called abridgment).

In a brilliant move, the federal government has applied the due process clause to the State of Texas’s law SB 8 and found it wanting.

SB 8 does run afoul of the 14th Amendment.

The enforcement provisions of SB 8 stand for the proposition that, whatever abortion rights women in Texas might be deemed to have under federal law, they have no federally protected right to *access* to abortion.

This is arrant nonsense.

Certainly, the federal government is under no constitutional obligation to provide abortion services itself, nor even to ensure that abortion services are available.

Nor is a state required to provide such services.

But clearly a state cannot act to ensure that abortion services are *not* available in the state,

either, because the right to have an abortion, at least during the non-viability period of the pregnancy, is a guaranteed federal right that cannot be impaired, impeded, or abridged under the due process clause of the 14th Amendment of the U.S. Constitution.

Scale is just a 10000 foot view. If people helped other people instead of well wishing, the problems would be resolved. When you create a community coffer for people to reach into and pull out money they never contributed to, and don't ever intend on paying back, you basically ensure people who actually need it will have much less than they would otherwise.

Look at COVID scale.. it's still one person infecting other people and so on. The Federal government didn't need to gather all the COVID and hand it out to the needy.

because its not about ME doing the right thing. this is a country of 330 million people.

i can get by just fine without the social programs that i advocate for. and based on our family's trajectory and future outlook we'd be the ones who would be paying higher taxes as a direct result. but i'm ok with that because i dont only advocate for policies that directly benefit me.

there are millions of folks who need help. me doing some personal charity isn't a drop in the bucket. thats not to say charity is bad. its just insufficient

I just don't know that defines a government being good or bad. The US has had largely an open border policy for centuries. Heck, illegal immigration was not even penalized by the US Constitution nor laws until much, much later after it's creation, and they were always loosely enforced.

This country was largely built by immigrants as well, which is an obvious reflection of that policy choice. The big difference back then is that black immigrants were called slaves and were not free. Heck, we loved to ferry in those 'immigrants' back in the day.

Which is really what brings us to today. We love to bring in the jornaleros to pick strawberries for the season nowadays. The problem is when they decide to stay, bring their families or vote.

There was nothing thinly veiled about the previous President stating that he would prefer we get immigrants from Norway instead of Mexico or Haiti. Nobody complains about British or Canadian immigrants or the cost we incur with them.

And obviously, there's nothing surprising about Norway saying, gee, no thanks. They're a fine country and in many respects their government does a much better job than ours do with our people.

At a personal level, what holds me here now is that I built a family here, and it would be hassle to move, but it's also not a possibility I discard outright either given the right opportunity.

But that's the point, the US has had a history of porous borders. And sorry, if you don't know that illegal immigrants contribute just as much as legal immigrants do, then that's on you.

The reality is that if any illegal immigrant ever wants to ever get legal papers, they need to show they paid taxes for at least 3 consecutive years, and the IRS provides illegal immigrants with a tax number to do so (called ITIN).

And if we're being honest, at least in my experience for the past 20+ years here, there's just as many if not more poor white people being the 'freeloaders'. Which really is not a failure of the safety net, it's a failure of oversight. Being American born doesn't give you the right to abuse any program.

I took exception to the notion that nobody here would want certain governments from other first world countries. I do think a plurality of people would actually like that, including the consequences that come with that (ie: more affordable healthcare in exchange for higher taxes, etc).

i've never disagreed with this. one thing we could also do is have more immigration judges so we can process more cases faster, ie expand the amount of legal immigration. we should also criminalize and enforce employers who hire illegals, something which isnt heavily emphasized right now

i dont think the border wall serves as much more than a symbol
