the unsigned order in Orr waves its hands at irreparable harm—asserting, with precisely zero support, that the district court’s injunction irreparably harms the government because it “enjoins enforcement of an Executive Branch policy with foreign affairs implications concerning a Government document.” As you might have noticed, there’s no discussion of how sex markers on a passport have any “foreign affairs implications,” let alone how those implications, whatever they may be, are somehow “irreparable.” In other words, the order does nothing (and, frankly, the Trump administration’s briefs don’t do much more) to explain how the district court’s injunction harms the “government’ at all—let alone in a way that can’t be fixed through an ordinary appeal.


This last point is especially telling, since the district court’s injunction simply returned the status quo to the very policy that the U.S. government had followed for the preceding 33 years. And lest this seem like a technical point, it’s absolutely essential to the majority’s analysis; without “irreparable harm,” the Trump administration would not be entitled to relief no matter what else is true about this case.

Over the course of three months, a three-judge District
Court in Texas undertook to resolve the factual dispute at
issue in this application: In enacting an electoral map
slanted toward Republicans, did Texas predominantly use
race to draw its new district lines? Or said otherwise, did
Texas accomplish its partisan objectives by means of a ra-
cial gerrymander? The District Court conducted a nine-day
hearing, involving the testimony of nearly two dozen wit-
nesses and the introduction of thousands of exhibits. It
sifted through the resulting factual record, spanning some
3,000 pages. It assessed the credibility of each of the wit-
nesses it had seen and heard in the courtroom. And after
considering all the evidence, it held that the answer was
clear. Texas largely divided its citizens along racial lines to
create its new pro-Republican House map, in violation of
the Constitution’s Fourteenth and Fifteenth Amendments.
The court issued a 160-page opinion recounting in detail its
factual findings.


Yet this Court reverses that judgment based on its pe-
rusal, over a holiday weekend, of a cold paper record. We
are a higher court than the District Court, but we are not a
better one when it comes to making such a fact-based deci-
sion. That is why we are supposed to use a clear-error
standard of review—why we are supposed to uphold the
District Court’s decision that race-based line-drawing oc-
curred (even if we would have ruled differently) so long as
it is plausible. Without so much as a word about that stand-
ard, this Court today announces that Texas may run next
year’s elections with a map the District Court found to have
violated all our oft-repeated strictures about the use of race
in districting. Today’s order disrespects the work of a Dis-
trict Court that did everything one could ask to carry out
its charge—that put aside every consideration except get-
ting the issue before it right. And today’s order disserves
the millions of Texans whom the District Court found were
assigned to their new districts based on their race. Because
this Court’s precedents and our Constitution demand bet-
ter, I respectfully dissent.

opportunity to hold an unlawful election. The District
Court, once again aptly, made the point: Were judicial re-
view so broadly foreclosed, then to implement even a “bla-

That cannot be the law—except of course that today it is.
According to the majority, Texas had a free pass to redis-
trict in August 2025 for the 2026 House elections. See ante,
at 2. All that the plaintiffs can hope for is better luck in
2028.

clear error. But under that deferential standard, the Dis-

arrogating to itself that court’s rightful function. We know
better, the majority declares today. I cannot think of a rea-

And this Court’s eagerness to playact a district court here
has serious consequence. The majority calls its “evalua-
tion” of this case “preliminary.” Ante, at 1. The results,
though, will be anything but. This Court’s stay guarantees
that Texas’s new map, with all its enhanced partisan ad-
vantage, will govern next year’s elections for the House of
Representatives. And this Court’s stay ensures that many
Texas citizens, for no good reason, will be placed in electoral
districts because of their race. And that result, as this
Court has pronounced year in and year out, is a violation of
the Constitution.

Lebene Konan, a realtor and landlord in Euless, Texas, alleges that United States Postal Service employees have subjected her to a yearslong campaign of racial harassment. In a federal lawsuit she filed in 2022, Konan says that two postal workers “did not like the fact” (https://www.supremecourt.gov/DocketPDF/24/24-351/327015/20240927121441285_USPS_v._Konan_Cert_Petn.pdf) that she, a Black woman, owned multiple properties and rented them out to white people. And so, beginning in May 2020, the USPS employees refused to deliver mail to her and her tenants. They changed the locks on her mailbox. They marked her mail undeliverable and returned it to the sender. They blocked her and her tenants from receiving doctor’s bills, medications, credit card statements, and more.


Frustrated, several tenants moved away, and took their rental income with them. In 2022, Konan sued the USPS under the Federal Tort Claims Act, alleging, among other things, tortious interference with prospective business relations and intentional infliction of emotional distress.


But on Tuesday, a divided Supreme Court ruled (https://www.supremecourt.gov/opinions/25pdf/24-351_7648.pdf) that Konan’s case cannot move forward. “The United States enjoys sovereign immunity and cannot be sued without its consent,” said Justice Clarence Thomas for the five-justice majority.


In dissent, the liberal appointees and Justice Neil Gorsuch contended that the United States did give its consent— in 1946, when Congress enacted the Federal Tort Claims Act. That law broadly waived sovereign immunity to allow people to sue (https://www.law.cornell.edu/uscode/text/28/1346) the government if they’re injured by government employees.


One of the FTCA’s exceptions prohibits people from suing for claims “arising out of the loss, miscarriage, or negligent transmission of letters or postal matter.” This carveout shields postal workers from liability if, for example, they accidentally drop a box containing glassware or misplace some correspondence from a pen pal. The Voting Rights Act, among the most consequential pieces of U.S. civil rights legislation, was signed into law in August 1965. It came nearly a century after the 15th Amendment outlawed racial discrimination in voting in 1870.

In the Senate, the author of the 13th Amendment, Lyman Trumbull of Illinois, proposed that Congress declare its Reconstruction Acts “political in their character, the propriety or validity of which no judicial tribunal is competent to question.” As the threat from one pending Supreme Court case became urgent, Congress enacted a narrower but decisive measure stripping the court of appellate jurisdiction over the particular challenge before it.

That strategy worked. Disciplined by Congress, the court declined to interfere with its abolition or Reconstruction Acts. As federal prosecutors and lower courts enforced these statutes, over 750,000 Black Americans voted for the first time. Black men even took seats in Congress, where they helped draft and pass the nation’s first national voting rights laws.
