    If cities deciding they want shelter in place is halal, why isn't it cool if governors want the same?

    Non-medical pandemic countermeasures have broad popular support, btw, ot's not like mayors and governors have been flauting the will of the people, they're doing what they were elected to do, protect public welfare.

    Governors shouldn't be unilaterally making up law. My position on this has been quite clear.

    Governors have police power. Using that power isn't "making up law," it's given to governors by law.

    Using police power in emergencies is one of the things we elect governors for.

    It's legit to argue the wisdom of the instances of that power, but suggesting as you do that such actions are unlawful per se is surely mistaken: the use of emergency power by governors to protect public health is settled law.
