    If it’s copyrighted then you sure do.
    Of course you have to ask for permission and/or pay a license for copyrighted works. It's called the Public Performance right.

    Under the public performance right, a copyright holder is allowed to control when the work is performed "publicly." A performance is considered "public" when the work is performed in a "place open to the public or at a place where a substantial number of persons outside of a normal circle of a family and its social acquaintances are gathered." A performance is also considered to be public if it is transmitted to multiple locations, such as through television and radio. Thus, it would be a violation of the public performance right in a motion picture to rent a video and to show it in a public park or theater without obtaining a license from the copyright holder. In contrast, the performance of the video on a home TV where friends and family are gathered would not be considered a "public" performance and would not be prohibited under the Copyright Act.

    This was never a thing 'till the McCain/Romney campaigns when certain artists complained and they capitulated. This not based on law whatsoever.
    Yea, of course BMI and ASCAP swooped in and acted like it was.
    Once music is released into the public domain, it is what it is. If you throw a party, you don't call up Tom Petty's people and ask permission to do so.
    This is America, not the USSR. People have rights.

    His songs are not public domain. You don't buy songs and music, you license them. And no, you can't do whatever with a music you "bought", you are limited by the terms of the license.

    You license them for commercial use. Otherwise, they are used. If you have a big little league kickoff party in the community you just play whatever music. You don't license it.
    Again, this was never a thing until these gots pretended it suddenly was.
