This is where the whole thing falls apart for me too. Even if any of the Trumps was found guilty of a crime meriting prison time, they'd have the prison sentence commuted by whoever was President - whether it's Pence, or Pelosi or Biden - in order to "let the nation heal" (translated: prevent MAGA terrorism.)
