In an interview with John Solomon on a Just the News election special, renowned legal scholar Alan Dershowitz said that Trump campaign legal challenges to 2020 presidential election results could rise to the Supreme Court provided that plaintiffs demonstrate that sufficient numbers of votes were affected to influence outcomes in particular states.
Dershowitz believes the Trump team has a chance of prevailing in Pennsylvania. "At least under the Cons utional challenge, the Article II challenge in Pennsylvania, they have a pretty good chance of winning," he said.
Victoria Toensing and Joe diGenova, members of the president's legal team, spoke about the ongoing legal battle during the special.
The Supreme Court is "not gonna take a case, a big case, unless it determines the outcome of the election," diGenova said. "So that means the president has to win additional states."
Toensing said that states with Republican-controlled legislatures, if they chose, could refuse to certify.
